PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to a system for updating Community Plans, batching General Plan Amendments, Environmental Impact Report (EIR) consultants and technical plans.

Recommendations for Council action, as initiated by Motion (Huizar, et al. – Krekorian):

INSTRUCT the Department of City Planning (DCP) and the City Administrative Officer (CAO) to report with the necessary budget resources, staffing needs and funding analysis to implement a six year, accelerated update cycle, and for the DCP to report with a draft ordinance to codify that requirement.

INSTRUCT the DCP to immediately implement administrative procedures to batch General Plan Amendments, and to begin working on an ordinance to make General Plan Amendments batching the law.

INSTRUCT the DCP to immediately implement EIR Processing Option Two of the DCP report dated January 26, 2017 (attached to Council file No. 16-0422), requiring that all future EIRs associated with development be prepared only by City-approved consultants, and an applicant hire a consultant from the City’s pre-qualified list.

INSTRUCT the DCP to issue an Request for Qualifications to establish a Pre-Qualified List of environmental consultants.

Fiscal Impact Statement: Neither the CAO nor the Chief Legislative Analyst has completed a financial analysis of this report.

PROPOSED ORDINANCE:
An ordinance adding Section 21.18 and amending Section 16.02 of the Los Angeles Municipal Code, as well as adding Section 5.578 of Chapter 172 of the Administrative Code, establishing an Affordable Housing Linkage Fee, and directing Linkage Fees derived from Development Projects to the Housing Impact Trust Fund.
REQUESTED ACTIONS:
1. Consider based on the whole of the administrative record, that the proposed ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15378(b)(4) and 15061(b)(3) and, pursuant to CEQA Guidelines Section 15074(b), adopt ENV-2016-3432-ND;

2. Approve and recommend that the City Council adopt the proposed ordinance;

3. Recommend that the City Council direct the Housing and Community Investment Department to prepare an expenditure plan for allocating the Housing Impact Trust Fund revenues generated as a result of the proposed ordinance, and report to the City Council within six months;

4. Adopt the staff report as the Commission report on the subject; and

5. Adopt the Findings as recommended by staff.

Recommendation for Council action:

REQUEST the City Attorney to prepare and present an ordinance, with an urgency clause, to amend the Los Angeles Municipal Code (LAMC) provision for a one-day permit for Valet Parking Operators that provide valet services for events at private residences [LAMC Section 103.203, Subsection (b)] to read, substantially as follows:

With the following exception, no permit shall be required under this section if the Valet Parking Operator is providing services for a non-recurring special event at a private residence. A one-day permit shall be required for a Valet Parking Operator providing services at a private residence, including for a non-recurring special event, if the residence is in a valet parking sensitive zone as designated by the Board of Police Commissioners and the movement of vehicles is on or over any public right-of-way or public property. The Board of Police Commissioners through its Executive Director may issue a one-day permit to a Valet Parking Operator for valet services in a valet parking sensitive zone after a determination by the Executive Director that the valet service will not adversely affect public safety or create a public nuisance. The Executive Director, after investigation and review, may recommend to the Board of Police Commissioners the designation of a valet parking sensitive zone with specific geographic boundaries and rules and regulations to be imposed on Valet Parking Operators when providing valet services within the zone.

The City’s diverse and talented workforce is the lifeblood of Los Angeles, providing a
wide array of essential services to all Angelenos. I am committed to maximizing the
wellness and safety of our residents and those who serve them.

I am also committed to other aspects of risk management, including minimizing liability
claims and litigation. Liabilities take many forms, including general liability, vehicle
liability, employment liability, and workers’ compensation liability. The City’s growing
workers’ compensation costs comprise the vast majority of its overall liability costs.

Since I became Mayor, I have taken actions to manage overall risk in ways that are
flexible and meaningful, that focus on the outcomes of risk management, and that utilize
performance indicators and performance-based budgeting. I have met with the Heads
of all City Departments, including the proprietary Departments, to discuss the purpose
and implementation of measures to manage the risk of liabilities and my expectations
regarding managing risk. On an ongoing basis, the Deputy Mayor for Budget and
Innovation follows up with General Managers on their risk-management strategies, and I
include the effective management of litigation risk and workers’ compensation liabilities
in their annual performance evaluations and salary reviews. My staff and I have
consulted with our employee representatives on ways to improve risk management and
employee wellness. We also have worked closely with the City Attorney, the members
of the City Council, and their staffs to address these matters. …
