A Matter for Study – L.A. officials push for new steps to address health risks from homebuilding near freeways

Planning, transportation and other officials should prepare “strategies to address the hazard of freeway pollution affecting residents of new and existing structures,” according to a motion filed this week by councilmen Jose Huizar and Paul Koretz. These could include buffer zones and barriers, air filtration requirements and regulations on building design.

The proposal cites a recent Los Angeles Times story that found the city keeps approving homes in high-pollution zones near freeways despite more than a decade of warnings from air quality regulators and scientists.

“I think it’s about time,” said Huizar, who represents a district stretching from downtown to Eagle Rock. “We’ve had report after report … about how living next to a freeway is detrimental to people’s health. We need to have a comprehensive study.”

More than 1.2 million people in Southern California already live within 500 feet of a freeway and suffer from higher rates of asthma, cancer, heart attacks, preterm births and a growing list of other health problems, according to the Times story, which analyzed U.S. Census data, building permits and other government records.

And the population is growing as Los Angeles and other cities approve thousands of homes within 500 feet of freeways, where California air quality officials have since 2005 advised against placing more residents.

Mayor Eric Garcetti said Friday that he supports Huizar’s plan to explore new regulations for development near freeways.

“We should look at both zoning requirements and technology to ensure that people who live in housing always live healthy,” Garcetti said. “I grew up next two freeways during leaded gasoline days. My family’s experienced cancer. We had a cancer cluster on our street, so I’m very personally sensitive to this. So absolutely. Whether it’s through spacing, or through technology and ventilation, we should be looking at ways of protecting Angelenos.”

Garcetti and other local politicians have opposed limits on how many homes can be built near freeways, arguing that such restrictions are impractical and will hinder efforts to ease a severe housing shortage.

Any discussion about new development regulations must include developers of affordable and market-rate housing, said Stuart Waldman, president of the Valley Industry and Commerce Assn., a business group based in the San Fernando Valley. New restrictions, he said, have the potential to “devalue land and make it harder to build.”

“Anything that restricts the opportunity to build increases housing costs,” Waldman added.

Huizar’s proposal calls for the analysis to “consider the competing concerns of our current housing affordability crisis and the potential impact of limits to development near freeways.”

Los Angeles officials began considering the issue several years ago in response to mounting science linking traffic pollution to an array of illnesses, including childhood obesity, autism and dementia. In 2012 the planning department began sending health advisories to developers who filed applications to build housing within 1,000 feet of a freeway. About 600,0000 Angelenos lived that close to a freeway in 2010, according to Times analysis of U.S. Census data.

Those developers were informed that city officials had the power, in certain instances, to impose anti-pollution measures, such as changes in building designs to situate residents away from traffic, windows that do not open or additional trees and shrubs to provide barriers. But such modifications are not required.

Los Angeles officials, faced with continued development near freeways, went further last year, changing the building code to require enhanced air filtration systems in new homes within 1,000 feet of a freeway.

City officials have faced criticism from neighborhood groups and environmentalists for continuing to approve freeway-adjacent apartment projects, including some with balconies directly overlooking traffic.

Cities have broad land-use authority and could limit home construction near freeways to protect public health if they wanted to, according to legal experts. Los Angeles officials have so far focused on improving air filtration, building design and vehicle emissions.

That doesn’t go far enough, health advocates and air quality regulators say, in part because it will take many years for stricter vehicle emissions standards to phase in and reduce health risks. Putting space between people and pollution through development restrictions, they say, is the only sure-fire protection.

“Until everyone drives electric cars, we need to stop building houses next to freeways,” said Joseph Lyou, a member of the South Coast Air Quality Management District board who heads the Coalition for Clean Air. He praised Huizar “for taking this public health issue seriously.”

Huizar said he wants city officials to develop a long-term approach to the issue by examining such options as regulations supporting electric cars and buffer zones that keep new housing a specific distance away from freeway.

Over the past decade, Huizar’s district has seen new multistory housing go up near freeways in downtown, Boyle Heights and elsewhere. One particularly noticeable example, he said, is the Da Vinci, a 526-unit apartment complex completed in 2016 alongside the 101-110 freeway interchange.

That development is too close to the freeway, Huizar said. “I ask myself, what planning policies allowed that to happen?”

A Matter for Study – Homelessness & housing toolkit for cities

Many jurisdictions have adopted regulations governing temporary homeless encampments, which are intended to provide emergency housing for relatively short periods of time. However, some regulations are not as clear with respect to other types of uses that address homelessness.

Does the City of Los Angeles have regulations that define what constitutes a permanent shelter, as opposed to one that moves to a different location every 90 days? Do our regulations define what constitutes transitional housing? Day centers are important since many overnight shelters are not open during the daytime but does our City define a use that includes day centers?

Are our regulations clear about which zones allow these uses and what process applies to permit applications to site such facilities? Clear regulations will help an applicant and concerned citizens understand the land use permitting and streamline the process by which such facilities may be reviewed and approved.

Department of City Planning Single -Family Residential Zone Regulations and R1 Variation Zones

Summary

To address out -of-scale development and related construction impacts in single -family neighborhoods, the City Council adopted amendments to the Zoning Code. The new citywide regulations governing both the scale and mass of single- family homes went into effect on March 17, 2017. They appl y to new or enlarged homes in all single -family residential zones.

To reflect the character -defining features of our individual neighborhoods, a new subset of zones within the R1 Zone was also created – the R1 Variation Zones . Conceived out of a desire to move away from a one -size -fits all approach to residential zoning, the R1 Variation Zones offer neighborhoods more tailored development standards.

While only a handful of communities will immediately benefit from the creation of the R1 Variation Zones, neighborhoods across the City eventually will have the ability to opt into one of the newly -created zones as c ommunity plans are updated. In adopting these new regulations , the City provides additional protections for the cohesion and char acter of its single -family neighborhoods.

NEGATIVE DECLARATION, PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to amending Sections the Los Angeles Municipal Code (LAMC) to establish variations of the R1 Zone and a RG Rear Detached Garage Supplemental Use District.

Recommendations for Council action:

FIND that this project will not have a significant effect on the environment, pursuant to the City’s Environmental Guidelines and is in compliance with the CEQA; that the Negative Declaration reflects the independent judgment of the City of Los Angeles; that the documents constituting the record of proceedings in this matter are located in Council file No. 16-1460 in the custody of the City Clerk and in the files of the Department of City Planning (DCP) in the custody of the Environmental Review Section; and, ADOPT the Negative Declaration [ENV-2016-2111-ND].

For all other lots, the maximum Residential Floor Area contained in all buildings and accessory buildings shall be as follows: In the RE9 and RE11 Zones, the maximum Residential Floor Area shall be 40 percent of the lot area when the lot is less than 15,000 square feet. For lots 15,000 square feet or greater in the RE9 and RE11 Zones, the maximum Residential Floor Area shall be 35 percent of the lot area or 6,000 square feet, whichever is greater. For lots in the RE15, RE20 and RE40 Zones, the maximum Residential Floor Area shall be 35 percent of the lot area.

Garcetti bans private meetings between developers and planning commissioners

Los Angeles Mayor Eric Garcetti has banned city planning commissioners from meeting or communicating privately with real estate developers whose plans they are vetting, following through on a pledge made last year.

The mayor, who signed an executive directive Thursday to halt the practice, said it would enhance trust in the planning process. Critics have argued that such private meetings tilt city decisions toward politically connected developers.

“We need to bring transparency and accountability to a process that, for too many, doesn’t feel like there’s enough,” Garcetti said. He signed the order two days after L.A. voters reelected him by a landslide and soundly rejected a controversial ballot measure that would have imposed new restrictions on development.

Garcetti had faced criticism for not barring such “ex parte” meetings sooner: The mayor had pledged to do so in a September letter urging AIDS Healthcare Foundation executive Michael Weinstein to abandon the push to pass Measure S, which called for a two-year moratorium on building projects that require zoning changes.

Weinstein has credited the Yes on S campaign for changing the conversation at City Hall and prodding Garcetti and other city leaders toward reform. The mayor insisted Thursday that he had been pursuing key changes before the ballot measure arose, although he acknowledged that banning ex parte communications had come up in talks with Measure S supporters.

Councilman David Ryu, who revived an old proposal to prohibit such meetings last fall, praised Garcetti for his action. “This is a major victory for transparency in local government,” Ryu said, urging the city to press forward with further reforms to limit the political influence of wealthy developers.

The ban signed Thursday applies to members of the city’s Planning Commission and the Cultural Heritage Commission, who are appointed by the mayor, as well as members of area planning commissions. They are prohibited from meeting or communicating privately with anyone about development plans unless they recuse themselves from the process.

Garcetti said that the private meetings or communications would be barred once a development project has been submitted to the city. The only exception, according to the executive directive, is for “scheduling, administrative or emergency purposes” — but only if nothing substantial is discussed and no one gets an advantage from the communication.

But Yes on S campaign director Jill Stewart said Thursday that the ban was too limited, contending such restrictions also should apply to the mayor and to members of the City Council. In a statement, the campaign said that private meetings should be banned before a developer formally files an application because “backroom meetings” could happen earlier.

“Ending ex parte communication only with his planning commissioners will have virtually no positive effect,” Stewart said.

Weinstein called the move an “important first step in beginning to curb the corruption at City Hall,” but he urged the City Council to stop meeting privately with developers as well.

“The people’s business should be done in public view,” Weinstein said.

Garcetti drew a distinction between city lawmakers and the commissioners who hold a “quasi-judicial” role — those who are required to hold a hearing and then make a decision by applying the law to the facts presented there. Last year, Garcetti said city lawyers had advised him that L.A. cannot legally prohibit residents from communicating with their elected officials.

“We hear from all sides, and we should hear from all sides,” Councilman Jose Huizar said at the Thursday news conference.

Some residents are troubled by private discussions involving other city planning officials.
The United Neighborhoods Neighborhood Council — which represents West Adams, Jefferson Park and Arlington Heights — recently raised concerns about an oil company executive communicating privately with a planning department official about the fate of a local drilling site. In a letter to city officials, the neighborhood group argued that the private communications posed a problem that “violates due process and damages us all.”

Garcetti spokesman George Kivork said that the mayor had focused the restrictions on planning commissioners, who decide the merits of a case. The planning department already prohibits zoning administrators from engaging in ex parte communications about cases before them, Kivork said.
It was unclear Thursday whether the mayor’s office had drafted a policy to ensure that Garcetti and his staffers disclose any ex parte meetings on development projects, another step that the mayor told Weinstein he would pursue.

In addition to curbing ex parte meetings, Garcetti directed the planning department to set a schedule for updating the General Plan, which governs development across the city, and reviewing the community plans, which guide what can be built in each neighborhood. The City Council recently voted to draft an ordinance that would require those community plans to be updated every six years, funded by an increased fee on building projects that need special approval from the city.

Although the ballot measure to restrict development failed, “this is not a time when we’re dancing and saying, ‘Hey, we won, we don’t have to do anything,’ ” Garcetti said Thursday.
