Recommendation for Council action, as initiated by Motion (Huizar – Harris-Dawson – Ryu):

DIRECT the LADBS to prepare an analysis of the Code Violation Inspection Fee to determine the fee amount required to achieve full cost recovery for code violation inspections and submit said analysis to Council.

Fiscal Impact Statement: The City Administrative Officer reports that there is no impact to the General Fund as a result of the recommendation of this report to direct the LADBS to report on the appropriate level for the Code Violation Inspection Fee to achieve full cost recovery.

INSTRUCT the Department of City Planning (DCP), to:

INSTRUCT the Los Angeles Department of Building and Safety, with assistance of the City Attorney, to prepare and present an ordinance to update subsections of the building code to establish an Electric Vehicle (EV) ready and EV charging requirement that exceeds current State standards and recognizes the importance of EV in the City, and addresses the minimum targets referenced in the DCP report dated July 26, 2018 and attached to Council file No. 17-0309.

(AQMD) Addressing Air Quality Issues in General Plans, Local Planning, and School Siting  (AQMD Planning  Guidance)

Heard at April 26, 2018 City Planning Commission :  Overview of the air quality challenges facing Los Angeles and the greater Southern California Basin, the various strategies that are currently being explored to reduce mobile source emissions , and potential strategies to limit exposure to pollutant matter and noxious gases.

Background On December 21, 2017, the Department provided the City Planning Commission (CPC) with an overview of the City’s policies and regulations pertaining to the review and consideration of new residential uses located adjacent and proximate to freeways. This overview included the 2012 Zoning Information Bulletin, ZI 2427 , which is an advisory to applicants of CPC cases, provides design and siting guidelines for discretionary residential projects , and sensitive uses and schools located within 1,000 feet of a freeway. The overview also included information about the specific freeway related regulations included in the 2016 Clean U p Green Up ordinance that mandates high efficiency air intake filters for freeway -adjacent residential buildings and requir es information al signage , regarding air quality hazards, in freeway adjacent civic buildings. While the Department’s efforts on this issue have largely focused on reducing the exposure of future residents to the negative pollutant levels emitting from freeways , it is also important to prioritize the reduction of mobile source emissions overall . Tail pipe emissions are the leading contributor of health -related impacts such as asthma, lung problems, heart disease, and stroke. As a result, health experts from such institutions as USC and UCLA continue to advocate for a combination of strategies that seek to reduce the extent of tail pipe emissions throughout the region and lessen the impact of mobile source emissions on our most vulnerable populations . These experts emphasize the value of encouraging and facilitating mobility choices such as walking, biking and transit while also strongly supporting strategies that promote increased prevalence of electric and/or clean fuel vehicles on our roadways.

At the December 2017 CPC meeting on this matter, the Department was directed to develop an inventory of additional actions to reduce and limit health impacts attributed to residing within close proximity to freeways. Additionally, concerns were raised regarding the maintenance and replacement of mandated high- efficiency air intake filters . Tasked with providing such recommendations, the Department reviewed several State and Federal studies that have provided insight on the complexity of this issue.

This report will also focus on ways to lessen the exposure to air pollution throughout the City and the important role the City and Department can play in reducing mobile source emissions in the first place.

New forms CP-3530 TFAR – Less than 50,000 Sq. Ft. and CP-3531 TFAR – 50,000 Sq. Ft. or Greater

Ordinance No. 181,574, effective 03/27/2011, amended in its entirety Transfer of Floor Area Rights in the Central City TFAR Area.  Its “purpose was to establish standards and approval procedures for the Transfer of Floor Area Rights in the Central City TFAR Area; to effect maximum coordination between the Community Redevelopment Agency and the City; to provide for the keeping of records of available Floor Area Rights within the Central City TFAR Area; to provide for an accounting of allocations of Public Benefit Payments and TFAR Transfer Payments derived from the Transfer of Floor Area Rights; and to facilitate those Transfers that generate Public Benefits.”  Moreover, the ordinance established separate procedures for transfers of less than 50,000 square feet and transfers of 50,000 square feet or greater.  (Section 14.5.1 Scope, Los Angeles Municipal Code)

In November 2016, City of Los Angeles voters approved Measure JJJ, which added provisions to the municipal code to require developers requesting certain entitlements for residential projects to either provide affordable units or pay an in-lieu fee. These requirements generally apply to applications for Zone Changes or General Plan Amendments that increase residential density and were deemed complete on or after December 13, 2016.

Measure JJJ also required the Department of City Planning to create a program to further incentivize affordable housing near transit. Accordingly, the Transit Oriented Communities (TOC) Affordable Housing Incentive Program became effective on September 22, 2017. The program encourages affordable housing within a half mile of major transit stops by providing additional density, reduced parking, and other incentives for projects that include covenanted affordable units.

The report linked below provides an overview of the housing outcomes of these measures and programs through June 30, 2018. Highlights include:

  • Anticipation of Measure JJJ and Measure S resulted in a high volume of housing units proposed in late 2016 and early 2017
  • While housing proposed through Zone Changes and General Plan Amendments has declined since the passage of Measure JJJ, the TOC program accounts for 19% of all units for which entitlements were filed in the past 9 months
  • To date, the TOC program has facilitated 5,571 proposed housing units, 1,145 of which are covenanted affordable
  • The TOC program has incentivized 417 Extremely Low Income (ELI) units, representing 36% of all affordable units proposed

The Small Lot Subdivision Code Amendment is a comprehensive update to the Small Lot Ordinance that: 1) modifies existing provisions of the Small Lot Ordinance to reduce previous ly established incentives for newly constructed small lot homes ; 2 ) establishes a process to further facilitate fee – simple homeownership opportunities through the preservation of existing housing within the City; 3) establishes a set of map standards to be discretionarily administered to all small lot subdivision maps; and 4) establish es an administrative review process that permits an enforceable design review process of small lot homes .
