RECOMMENDED ACTIONS:
1. Approve and recommend that the City Council find, based on the independent judgement of
the Commission, after consideration of the whole of the administrative record, that the project
was assessed in the previously certified Environmental Impact Report No. ENV-2008-3471-
EIR (SCH No. 1990011055), certified on April 24, 2013, and pursuant to State CEQA
Guidelines Sections 15162 and 15164, no major revisions are required to the EIR and no
subsequent EIR is required for approval of the project;
2. Approve and recommend that the City Council adopt the proposed ordinance and findings,
amending the Warner Center 2035 Specific.

An update to the Transportation Section of the Los Angeles CEQA Thresholds Guide to comply with State legislation (Senate Bill 743). State guidelines require all cities to update their transportation impact analysis metrics to vehicle miles traveled (VMT) before July 1, 2020. This approach prioritizes the safety and access of all street users. The State is also proposing a comprehensive update to the CEQA Guidelines. Accordingly, the Department of City Planning is updating its CEQA significance thresholds as part of the State’s 2019 update to CEQA.

DISCUSSION

Los Angeles City Planning Commission Adopts Recommendation to Change Los Angeles’ CEQA Traffic Significance Thresholds from LOS to VMT On March 11, 2019, the City Planning Commission adopted a recommendation that the city council update the city’s transportation significance thresholds under the California Environmental Quality Act (CEQA) pursuant to Senate Bill 743. To evaluate a project’s potential transportation impacts, SB 743 and the implementing CEQA guidelines require local agencies to implement significance thresholds that no longer focus on measuring automobile delay and level of service (LOS) but instead focus on a project’s impacts on vehicle miles traveled (VMT). The VMT approach is intended to reduce greenhouse gas emissions, help prioritize safety and access of all street users, and promote a diversity of land uses. The city council has not yet indicated when it will formally adopt the VMT thresholds, but there will be a phase-in process for projects undergoing environmental review. Projects that have already initiated obtaining a Memorandum of Understanding (MOU) from the Los Angeles Department of Transportation (LADOT) and have filed an application with the Department of City Planning (DCP) may analyze traffic impacts under the existing LOS thresholds. Projects that have not yet initiated an MOU with LADOT or filed an application with the DCP will need to prepare a VMT analysis. Because the applicable CEQA guidelines require that all local agencies apply the VMT threshold by July 1, 2020, the city will require any projects expected to complete the CEQA process after that date to include a VMT analysis.

RECOMMENDED ACTIONS:
1. Recommend that the City Council determine, based on the whole of the administrative record, that the proposed resolution is not a project under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21080(b)(1), CEQA Guidelines Section 15378 and is exempt from CEQA pursuant to CEQA Guidelines Sections 15061(b)(3) and 15308, and none of the exceptions in Section 15300.2 apply;
2. Approve and recommend that the City Council adopt the proposed Resolution pursuant to
Senate Bill 743 and CEQA Guidelines, Sections 15064.3 and 15064.7(b), updating the City’s
adopted transportation thresholds;
3. Adopt the staff report as the Commission’s report on the subject;
4. Adopt the findings; and
5. Recommend that the City Council instruct the Department of City Planning and the
Department of Transportation to report back annually for two years on status and any
additional changes needed to meet the intent of Senate Bill 743.

The Governor’s Office of Planning and Research adopted, in 2018, comprehensive updates to the California Environmental Quality Act Guidelines and Appendices. The Department of City Planning’s adoption of CEQA Guidelines and Appendix G as the Department’s CEQA Thresholds of significance will ensure compliance with existing State law and any future updates to State law.

RECOMMENDED ACTION:
Endorse the Department of City Planning’s adoption of the State CEQA Guidelines and Appendix G of the Guidelines as the Department’s CEQA Thresholds.

Los Angeles Readies to Adopt VMT for CEQA Analysis

For decades, the transportation impacts of all projects subject to CEQA – including housing developments, sporting venues, and transportation infrastructure – have been evaluated by the metric “Level of Service,” or LOS, a measure of automobile traffic congestion at signalized intersections surrounding a project site.  Any project determined to have a significant impact on LOS is required to provide mitigation measures, most frequently in the form or road widenings to increase vehicular throughput.

But by July 1, 2020, all California cities – including Los Angeles – are required to update their transportation impact analysis from LOS to Vehicle Miles Traveled (VMT).  Rather than treating traffic congestion faced by drivers as an environmental impact, this new metric instead considers the act of driving itself as the environmental impact.

VMT is calculated by multiplying the number of vehicle trips that a proposed development will generate by the estimated number of miles driven per trip.  But while LOS often required wider roads as a mitigation measure, projects expected to induce significant increases in VMT will be able to mitigate their impacts through measures such as car-sharing services, unbundled parking, improved transit, and enhanced pedestrian and bicycle infrastructure.

The change from LOS to VMT was mandated by the legislation SB 743, which was signed into law by former Governor Jerry Brown in 2013.  In Los Angeles, the transition is being jointly led by the Departments of City Planning (LADCP) and Transportation (LADOT), which have worked for the last five years to draft a framework for the city to evaluate projects through VMT.

LADCP

LADCP and LADOT, in collaboration with the consulting firm Fehr and Peers, have updated the city’s travel demand forecasting (TDF) model with trip generation rates collected from affordable housing, market-rate housing, office, and mixed-use developments through a variety of data sources – including cell phone and navigation-based location services.  The revised TDF model serves as the foundation of a publicly-accessible VMT Calculator, which was created to evaluate new developments.  Any project expected to generate 250 or more daily trips will be evaluated for VMT impact.

LADCP

Though the State of California has made its own recommendation for the CEQA impact threshold for VMT – specifically, 15 percent below the existing VMT per capita of the region – the size and diversity of the City of Los Angeles necessitates a more nuanced approach.

With that in mind, LADOT and LADCP have recommended that the expected VMT of a proposed development should be compared to the average VMT per capita of other projects within the same Area Planning Commission boundary.  The average VMT per capita in the jurisdictions of the city’s seven Area Planning Commissions are enumerated in the table below.

LADCP

Should a project exceed the impact criteria threshold for their respective APC areas, potential mitigation measures include:

  • reduced or “unbundled” parking;
  • neighborhood shuttles;
  • transit subsidies;
  • education programs to discourage automobile use;
  • employer-sponsored vanpools and rideshare programs;
  • car share programs;
  • bike share or other shared mobility devices;
  • improved bicycle infrastructure;
  • traffic-calming improvements; and
  • pedestrian network improvements.

The arrival of VMT also portends important changes to how land use plans – including the 35 Community Plans of Los Angeles – are evaluated through CEQA.  A staff report to the City Planning Commission notes that in future land use plans, potential mitigation measures for VMT could include “reallocation of future land use development to increase density in transportation-efficient locations,” such as those in close proximity to bus and rail lines, as well as to services and employment districts.

LADCP

Development around transit has become a contentious issue as Metro continues to build out new rail and bus rapid transit lines across Los Angeles County.  The new Expo Line Transit Neighborhood Plan brought this matter into focus last year, with pro-housing advocates decrying the plan as unambitious and those opposed to growth seeking to strip away increases in density.  Not long after the adoption of the Expo TNP, opponents filed a lawsuit seeking to overturn the plan.

State legislators have since started to weigh in on the matter, most notably San Francisco Senator Scott Wiener, who has introduced a bill which would allow for the construction of four- and five-story apartment buildings near rail stations, even when local zoning regulations forbid such projects.

LADOT and LADCP are set to report to the City Planning Commission tomorrow on the transition from LOS to CEQA.  After that point, the Departments expect that the policy change will be considered by City Council Committees in Spring 2019.  This will be followed by a nearly one-year phase-in period ending with the July 2020 deadline for the adoption of the VMT metric.

EXEMPTION, NEGATIVE DECLARATION (ND), PLANNING AND LAND USE MANAGEMENT (PLUM) COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to the implementation, enforcement, and administration of the Home-Sharing Program.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

FIND, that the adoption of the Ordinance does not constitute a project, as defined by California Environmental Quality Act Guidelines (CEQA), pursuant to CEQA Guidelines Section 15378.

FIND, that the adoption of the Ordinance is exempt from CEQA, based upon CEQA Guidelines Section 15061(b)(3), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment, where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

FIND, after consideration of the whole of the administrative record, that the City has complied with all of the procedural requirements related to the preparation, noticing and distribution of the Notice of Intent to Adopt a ND, the ND and the initial study supporting the determination of a ND, as set forth in Public Resources Code Section 21091 and CEQA Guidelines Sections 15071, 15072, and 15073; that there is no substantial evidence the project will have a significant effect on the environment; that the ND reflects the independent judgment and analysis of the City; and, ADOPT the ND.

ADOPT the FINDINGS of the Los Angeles City Planning Commission (LACPC) dated October 10, 2018 as the Findings of the Council.

PRESENT and ADOPT the accompanying new ORDINANCE, dated December 7, 2018, amending Sections 12.03, 12.12.2, 12.13, 12.13.5, 12.22, 12.24, 19.01, and 21.7.2 of the Los Angeles Municipal Code to regulate the use of a primary residence for home sharing as an accessory use, and to establish related fees and fines, to take effect on the latter date of either July 1, 2019; or, upon the effective date of an ordinance authorizing and regulating short-term rentals in non-primary residences (with the goal of such ordinance being approved by July 1, 2019).

The Department of City Planning is updating its Citywide Design Guidelines and invites members of the planning and design community to share ideas on the range of topics that should be included in the update. The updated Guidelines are being organized around three spatial categories: site planning, building design and right-of-way. The guidelines are intended to assist projects in meeting the City’s three design approaches which include: Pedestrian First Design, 360 Degree Design and Climate Adapted Design. Light refreshments will be served. Doors will open at 6:00 PM and discussion will begin at 6:30.
Transit/Parking: Los Angeles City Hall is served by Metro’s Red and Gold lines and numerous regional bus lines. Parking is available at the Aiso Street Parking Garage, 101 Judge John Aiso St, LA, CA 90012.

MOTION (MARTINEZ – SMITH) relative to the acquisition and development of real property to accommodate a new park within the boundaries of the Pacoima/Panorama City Redevelopment Area.

Recommendations for Council action:

INSTRUCT the Department of General Services (GSD), with the assistance of the Department of Recreation and Parks (RAP) and City Attorney, to negotiate a purchase and sale agreement with the owner(s) of real property located at 11957, 11961, and 11963 Allegheny Street, Sun Valley, CA 91352 (A.P.N. 2631-001-017 and 2631-001-018), or, in consultation with Council District 6, pursue alternative sites suitable for development of a park within the boundaries of the Pacoima/Panorama City Redevelopment Project Area, and report to Council with the purchase price and other terms and conditions of the acquisition.

INSTRUCT GSD to conduct all required due diligence including, but not limited to, a Class A appraisal of the properties selected.

TRANSPORTATION COMMITTEE REPORT relative to creating a pilot program to allow private entities to install Electric Vehicle (EV) charging stations in the public right-of-way.

Recommendation for Council action, pursuant to Motion (Huizar – Harris-Dawson):

INSTRUCT the Los Angeles Department of Transportation, in coordination with the Bureaus of Engineering and Street Services, the Los Angeles Department of Water and Power, and other departments as necessary, and in consultation with the Mayor’s EV Task Force, to present in 60 days, a pilot program to allow private entities to install EV charging stations in the public right-of-way, including rules and guidelines, a streamlined online application and permitting process, recommendations for locating new curbside charging stations, a new permit category for installing curbside charging, and the resources necessary to manage the program.

Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.
