PROPOSED PROJECT: An ordinance amending Sections 12.03, 12.22, and 19.01 of the Los Angeles Municipal Code (LAMC) to regulate the use of non-primary residences for short term rentals as Vacation Rentals, and to establish related fees and fines.

REQUESTED ACTIONS:

1. Recommend that the City Council determine, based on the whole of the administrative record,
that the proposed ordinance is exempt from the California Environmental Quality Act (CEQA)
pursuant to CEQA Guidelines Section 15301, and there is no substantial evidence
demonstrating that an exception to a categorical exemption pursuant to CEQA Guidelines
Section 15300.2 applies;
2. Recommend that the City Council determine that, based on the whole of the administrative
record, the project was assessed in Negative Declaration, No. ENV-2019-7046-ND, that there
is no substantial evidence that the project will have a significant effect on the environment.
3. Recommend that the City Council adopt the proposed ordinance (Exhibit A);
4. Adopt the staff report as the Commission report on the subject; and
5. Adopt the Findings (Exhibit B).

Tree Guarantee Fee Planting Plan / Tree Replacement Guarantee Ordinance / Proposal

PUBLIC WORKS AND GANG REDUCTION COMMITTEE REPORT relative to the Tree Guarantee Fee Planting Plan in regards to the Tree Replacement Guarantee Ordinance.

Recommendations for Council action:

ADOPT the Proposed Tree Guarantee Fee Planting Plan attached to the Board of Public Works (BPW) report dated November 26, 2019, attached to the Council file.

AUTHORIZE the BPW, in collaboration with the Department of City Planning, Bureau of Street Services (BSS) and Bureau of Sanitation, to approve and coordinate all tree-related planting efforts in the proposed Tree Guarantee Fee Planting Plan locations in each of the 15 Council Districts using fees (nonrefundable deposits) collected, in either group/bulk tree planting of no less than 25 trees per effort; or less than 25 individual tree planting(s) at least annually in a Council District with less than the equivalent funds required to plant and pay for 25 trees.

INSTRUCT the BPW to return to Council, as necessary, to seek future approval to amend the proposed Tree Guarantee Fee Planting Plan when any of each Council District proposed tree planting locations have been satisfied.

AUTHORIZE the BPW to make technical corrections or clarifications that may be necessary to implement the intent of the proposed Tree Guarantee Fee Planting Plan.

Fiscal Impact Statement: The BPW reports that the proposed Tree Guarantee Fee Planting Plan is an administrative matter to allow the planting of tree replacements using the Tree Guarantee Fees collected. Tree planting from Public Works Non-Subsidized and Planning Department Development project will have no impact to the General Fund. However, the planting of subsidized Public Works guaranteed trees will have a General Fund impact of approximately $397,686 (or 237 trees X $1,945 per tree minus $63,279). These costs are currently absorbed by the BSS similar to that of tree replacements (planting) from nursery bound trees.

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to amending the Los Angeles Municipal Code (LAMC) to update notification requirements for demolition permits.

Recommendations for Council action, as initiated by Motion (Blumenfield – Buscaino):

INSTRUCT the Los Angeles Department of Building and Safety (LADBS), with the assistance of the City Attorney, to prepare and present an Ordinance to amend LAMC Section 91.106.4.5.1 (Notification of Demolition) and any other pertaining section in the LAMC, to require protection devices such as fences and/or pedestrian protection canopies to be installed and approved by the LADBS a shorter amount of days before demolition begins, rather than 30 days before demolition begins as currently prescribed in the LAMC, and that requires 11 inch by 17 inch posted placards giving notice of demolition to contain letters two and half inches high rather than three inches as currently prescribed in the LAMC, allowing LADBS to send written notice of the Demolition Pre-Inspection Application to abutting property owners and/or occupants rather than sending written notice to abutting property owners and occupants.

INSTRUCT the LADBS, in coordination with the City Attorney and Los Angeles Police Department, to report back concurrently at the time the final Ordinance is submitted to the Council, on costs and benefits as well as recommendations of the feasibility to require protection devices such as fences and/or pedestrian protection canopies to be installed and approved by the LADBS less than 30 days and more than seven days before demolition begins.

Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.
