Recommendations for Council action, pursuant to Motion (Ryu – Krekorian):

INSTRUCT the Los Angeles Department of Building and Safety (LADBS), Department of City Planning (DCP), Los Angeles Department of Water and Power (LADWP), and the Los Angeles Housing and Community Investment Department (HCIDLA) to identify building, zoning, housing, and municipal code violations impacting community well-being and prepare a report back to the City Council outlining additional deterrence tools that can be adopted to remedy these violations, including but not limited to LADWP shut-offs, Certificate of Occupancy holds or revocations, permit prohibitions on the same or related properties, and scorched earth penalties, as amended by the PLUM Committee.

REQUEST that the City Attorney prepare and present an Ordinance based on the deterrence tools recommendations by LADBS, DCP, LADWP and HCIDLA that can be used to hold property owners accountable for parties hosted at their properties that violate the County Public Health Order and put public health at risk during this COVID-19 pandemic; said penalties should be in addition to those available under the Loud and Unruly Gatherings Ordinance.

City Planning Proposes to Streamline Rules for Future Development

New Enhancements Aim to Standardize the Current Review Process for Projects

LOS ANGELES—Today, City Planning released a framework for an entirely new system to house Los Angeles’s updated Zoning Code. The proposed Processes and Procedures Ordinance would streamline and consolidate the administrative provisions of the Zoning Code in one centralized location. These improvements will make traditionally cumbersome and complex systems easier for local businesses to navigate, particularly as many try to survive and move towards economic recovery and viability.
Several years ago, City Planning set out to create a modern and efficient zoning system for Los Angeles. The Processes and Procedures Ordinance marks an important milestone in this project, laying the groundwork for a modern Zoning Code that will take Los Angeles into the future. Since then, City Planning has held various public hearings and stakeholder meetings to gather public comment.
The ordinance would make the rules for project review easier to understand by introducing a standardized format for processes with consistent procedural elements. The easy-to-read format outlines each process and the steps in the project approval path and includes flowcharts that depict the steps in the process.
The ordinance also consolidates similar entitlements to follow the same procedures and eliminate redundant variations, reducing the total number of processes from over 120 to about 60. From a community perspective, these streamlined changes will assist in reducing ambiguity around planning approvals requested in the City and who has decision-making authority. The ordinance focuses on making the land use process more transparent and predictable for all by standardized time periods for notification of public hearings and filing of an appeal, for example.
“Development reform has long been a stated goal of this Department,” said Vince Bertoni, Director of Planning. “With this initiative, we have been able to strengthen our rules to promote greater accountability and transparency, while at the same time we are also expanding public participation and inclusion in our land use decisions—bringing Neighborhood Councils and residents alike into the fold.”
City Planning has prepared an annotated version of the ordinance to aid the public in tracking the changes to the Zoning Code. Each section of the ordinance is annotated to indicate which provisions are new, which have been revised, and which have been moved from another section as part of the reorganization of the Code. City Planning staff is proposing revisions and soliciting feedback on the modifications which will be presented to the City Planning Commission (CPC) for their consideration.
The Department has also prepared an interactive website as a resource for stakeholders at all levels of familiarity with current Zoning Code. This resource depicts key changes proposed in the ordinance and includes videos that illustrate the core concepts behind how the ordinance improves on the current system.
Later this winter, City Planning will facilitate virtual meetings to walk community members through the proposed changes. The ordinance will then advance to the CPC, and later to City Council, for their consideration.

Fiscal Impact Statement: The CAO reports that the recommendations of this report would have a positive impact on the General Fund as the revenue from the proposed per-night fee and recommendation to increase registration and renewal fees would eliminate the current estimated $2.9 million in General Fund subsidized costs associated with the HSO comprised of an estimated $601,227 subsidy for registration and renewal activities and $2.3 million for HSO program administration, monitoring and code enforcement not currently recovered by any existing fee.
Financial Policies Statement: The CAO reports that the recommendations of this report comply with the City’s Financial Policies in that fees are recommended at levels to achieve full cost recovery for regulatory activities related to the enforcement of the HSO.

AD HOC ON COVID-19 RECOVERY AND NEIGHBORHOOD INVESTMENT COMMITTEE REPORT relative to the CARES Act funds for the continuation, support, and expansion of the LA Al Fresco Program.

Recommendations for Council action, as initiated by Motion (Krekorian – O’Farrell – Martinez), SUBJECT TO THE APPROVAL OF THE MAYOR:

RECEIVE and FILE the October 19, 2020 Los Angeles Department of Transportation (LADOT) report, attached to the Council file.

INSTRUCT the City Administrative Officer (CAO) to allocate CARES Act funds totaling $2 million to the continuation, support, and expansion of the LA Al Fresco Program.

INSTRUCT the LADOT to take the following action:
Make any necessary changes to the program to improve its efficiency and maximize the number of participating restaurants, as well as ensure that CARES Act funds allocated to the program are able to be used prior to December 31, 2020.

Report with measures to streamline the program for future participants, including standard designs for installation of parklets and a predictable cost structure for different design options so that applicants who wish to participate in the LA A1 Fresco Program may do so at their own expense after these funds are fully expended.

CREATE new Account No. TBD, DOT CRF Projects within CAO Department No. 10, COVID-19 Federal Relief Fund No. 63M.

INCREASE appropriations totaling $1,994,622 within CAO Department No. 10, COVID-19 Federal Relief Fund No 63M in the following accounts:

PUBLIC SAFETY and PLANNING AND LAND USE MANAGEMENT COMMITTEES REPORTS relative to existing and potential evacuation routes in Very High Fire Hazard Severity Zones and updating the safety element of the General Plan to incorporate the Local Hazard Mitigation Plan and Fire Hazard Planning provisions.

PUBLIC SAFETY COMMITTEE REPORT

Recommendations for Council action, pursuant to Motion (Bonin – Koretz):
DIRECT the Department of City Planning (DCP), with assistance from the Emergency Management Department (EMD), Los Angeles Department of Transportation, the Los Angeles Fire Department (LAFD), and relevant departments, to report back on the capacity, safety, and viability of existing and potential evacuation routes in Very High Fire Hazard Severity Zones and identify the policies and development standards, including land use and building restrictions, necessary to support these evacuation routes.

DIRECT the DCP, with assistance from the EMD, LAFD, and relevant departments, to amend the General Plan by incorporating the Local Hazard Mitigation Plan and Office of Planning and Research’s Fire Hazard Planning provisions into the Safety Element concurrent with the ongoing update of the Housing Element.

REQUEST the Los Angeles City Planning Commission, after reviewing the update to the Safety Element of the General Plan, to submit its report and recommendations to the City Council.

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT
Recommendations for Council action, as initiated by Motion (Bonin – Koretz):
CONCUR with the Public Safety Committee as detailed above in Recommendation Nos. 1, 2, and 3.
DIRECT the DCP, with assistance from the EMD and other relevant City departments, to update the Safety Element of the General Plan concurrent with the Housing Element update to:
Address State and Local goals for climate adaptation and resilience.

Build upon the Local Hazard Mitigation Plan and provide comprehensive climate vulnerability assessments that identify the unique risks climate change poses to the City and each of the Community Plan Areas to inform adaptive and resilient policies, objectives, and implementation measures.

Slow Streets L.A. Program / Update

TRANSPORTATION COMMITTEE REPORT relative to the status and future recommendations for the Los Angeles Department of Transportation (LADOT) Slow Streets L.A. Program.

Recommendations for Council action:

APPROVE the continuation of the Slow Streets L.A. Program as detailed in the LADOT report to Council dated October 15, 2020.
DIRECT the LADOT to report to Council in 90 days on the status of the Slow Streets L.A. Program.
Fiscal Impact Statement: The LADOT reports that this action will not impact the General Fund. Proposed Slow Streets L.A. Program installations are funded through $800,000 that was originally allocated to the City’s Open Streets Program. The sources of these repurposed funds are Metro grant funds, front-funded by Measure M local return funds, and City Measure M local return match funds.

Recommendations for Council action, as initiated by Motion (Ryu – Buscaino):

DIRECT the Chief Legislative Analyst (CLA), the Los Angeles Department of Transportation (LADOT), and the Bureau of Engineering, with the assistance of the Bureau of Street Services, the Departments of Building and Safety and City Planning, the Los Angeles Fire Department, and the City Attorney, to report relative to the feasibility of developing a permanent Al Fresco program that allows for a streamlined outdoor dining permit process, including but not limited to a potential program structure, eligibility criteria, safety and infrastructure requirements, and a plan that would enable interested businesses to opt-in to the permit program.

DIRECT the CLA, with the assistance of the City Attorney, Bureau of Engineering, and the LADOT, to report on any changes to State, County, and City Codes needed to effectuate this program.
