ADOPT the accompanying RESOLUTION to include in the City’s 2021-2022 State Legislative Program SUPPORT for AB 832 (Bloom), which would transfer to the City of Los Angeles all land use related plans and functions of the former CRA/LA, and would make the amendment or repeal of those land use related plans or functions exempt from specified provisions governing community redevelopment.

CATEGORICAL EXEMPTION, PLANNING AND LAND USE MANAGEMENT (PLUM) COMMITTEE REPORT, ORDINANCE FIRST CONSIDERATION, AND RESOLUTION relative to amending the Specific Plan for the Management of Flood Hazards, established by Ordinance No. 154,405 and amended by Ordinance Nos. 163,913 and 172,081, to update it to meet current Federal standards, and to rename it as the Flood Hazard Management Ordinance.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

FIND that public comment has been satisfied per the public hearing held during the April 8, 2021 Special PLUM Committee Meeting.

FIND, based on the whole of the administrative record, that the draft Ordinance prepared by the City Attorney, dated April 8, 20201, and Resolution are exempt from the California Environmental Quality Act (CEQA) pursuant to California Public Resources Code Section 21080(b)(1), and CEQA Guidelines Section 15308, (Class 8 – categorical exemption for actions taken by regulatory agencies to assure the maintenance, restoration, enhancement, or protection of the environment), and that none of the exceptions under Section 15300.2 apply; and, that pursuant to CEQA Guidelines Section 15378(b)(5), the draft Ordinance, including the Resolution, is not a “project” as defined by CEQA.

ADOPT the Findings of the PLUM Committee, as included in the Los Angeles City Planning Commission (LACPC) report to the Council dated March 30 2021, including the Department of City Planning (DCP) staff report, and the Findings included in the Director of Planning’s report dated April 7, 2021, pursuant to City Charter Section 559 and relative to the draft Ordinance, as the Findings of Council, pursuant to City Charter Section 558(b)(3) and Subsection (b)(2); and, FIND that the adoption of the draft Ordinance is in conformity with the public necessity, convenience, general welfare, and good zoning practice, and that the action is in substantial conformance with the purposes, intent, and provisions of the General Plan as required under City Charter Section 556.

ADOPT the accompanying ORDINANCE, dated April 8, 2021, and RESOLUTION relative to an Amendment of the Flood Hazard Management Specific Plan to conform to Federal regulations and maps relating to the National Flood Insurance Program, established by Ordinance No. 154,405 and amended by Ordinance Nos. 163,913 and 172,081; and, to rename it as The Flood Hazard Management Ordinance, pursuant to the procedures set forth in Section 12.32 of the Los Angeles Municipal Code and City Charter Sections 558 and 556.

California Environmental Quality Act Consultant List

The Los Angeles Department of City Planning has created a standard list of consultants from which applicants will be required to hire when preparing environmental content pursuant to the California Environmental Quality Act for development projects. Each consultant on the City’s standard list will be required to have a contract with the City of Los Angeles Department of City Planning that guides the terms, conditions, and performance standards for the required work. Effective April 30, 2021, applicants will be required to select from among the following City-approved firms:
Applicants who have filed their applications and paid their fees with the City prior to April 30, 2021 may continue to use the firm that they previously selected for that particular project until that project is completed. As of April 30, 2021, however, applicants must use one of the consultants referenced above.
The selection process for awarding environmental consulting services work to consultants on the City’s pre-qualified list will be determined by the applicant. The applicant will enter into a direct contract with their selected consultant governing the full scope of their arrangement. The scope of that contract between the applicant and their selected consultant must be developed in compliance with the Environmental Review Criteria and Performance Standards identified in Exhibit I of the consultant’s contract with the City of Los Angeles Department of City Planning and must comply with all relevant terms and conditions set forth in said contract.
The City does not guarantee project awards to any consultants on this pre-qualified list, as applicants are solely responsible for the selection and payment of their consultants.
In order to ensure that an approved consultant has been selected, applicants must provide notice of their consultant selection to the City in writing upon the sooner of six months after an Environmental Assessment Form is submitted to the City or in advance of producing any CEQA drafts. All work prepared by the consultant will be performed for, on behalf of, and at the direction of the City of Los Angeles. The City retains the right to update this list as needed.
Please note, that as part of the Department’s review of Environmental Impact Reports, Planning staff will be evaluating EIRs against the Environmental Review Criteria and Performance Standards (released in November 2020).
