California HCD Housing Element Annual Progress Reports

The updated list reflects the latest data submitted to California Housing Community Development (HCD) by jurisdictions in their “housing element annual progress reports,” which show the number of housing permits issued relative to each jurisdiction’s housing need. Each April, all 539 jurisdictions in California must submit their annual progress reports, covering the prior calendar year’s activities.View the press release.

CRA Eligibility and Tract Median Family Income Data

The Community Reinvestment Act (CRA), passed by Congress in 1977, was established to encourage banks to extend credit to low- and moderate-income Americans. CRA requires that financial institutions undergo periodic evaluations to determine whether they are meeting the credit needs of the communities in which they operate, including low- and moderate-income neighborhoods. Every year, the Federal Financial Institutions Examination Council (FFIEC) releases data on CRA eligibility and tract median family income as a percent of area median family income, and you can find both of these indicators on PolicyMap in the Federal Guidelines tab.

What Makes a Census Tract CRA Eligible?

Tracts are eligible if they are low- or moderate-income, or if they are nonmetropolitan middle-income tracts designated by the FFIEC as distressed or underserved. Low- and moderate-income Census Tracts are based on a comparison of tract median family income to area median family income:

  • Low: tract median family income less than 50% of area median family income
  • Moderate: tract median family income greater than or equal to 50% and less than 80% of area median family income
  • Middle: tract median family income greater than or equal to 80% and less than 120% of area family median income

Any tract with a median family income greater than 120% (shown in dark purple on the map below) is considered upper-income and is not CRA eligible.

Recommendation for Council action:

AUTHORIZE the General Manager, Department of City Planning, to execute Amendment No. 3 to Contract No. C-122418 with Code Studio, Inc. for continued services related to the rewriting of the Zoning Code and to extend the term for two years, for a revised term of June 25, 2013 to June 25, 2020, without a change to the total compensation amount, subject to the review of the City Attorney and compliance with the City’s contracting requirements.

Fiscal Impact Statement: The City Administrative Officer reports that there is no fiscal impact to the General Fund. Funding for this contract is available from the Construction Services Trust Fund, Fund No. 438; however, no additional funding is required for this amendment. The recommendation in this report complies with the City’s Financial Policies in that funds are budgeted for this contract.

Affordable Housing Linkage Fee (AHLF) Exemption / Middle-Income Households

HOUSING and PLANNING AND LAND USE MANAGEMENT COMMITTEES’ REPORT relative to an Affordable Housing Linkage Fee (AHLF) exemption for middle-income homeownership.

Recommendation for Council action:

REQUEST the City Attorney to prepare and present an Ordinance to amend Los Angeles Municipal Code (LAMC) Section 19-18-B.2 (Affordable Housing Linkage Fee: Applicability Exemptions) substantially as detailed in the May 21, 2018 Los Angeles Housing and Community Investment Department (HCIDLA) report, attached to the Council file, and as follows:

2. Exemptions

c) Any single for-sale housing unit that:

a. Is restricted to and dedicated for first-time homebuyers.

b. Is owner-occupied by the first-time homebuyers.

c. Is affordable to middle-income first-time homebuyers earning up to 150 percent of Area Median Income (AMI), adjusted per household size, and sold at a price not to exceed the current maximum home purchase price limits established under the City’s Mortgage Credit Certificate (MCC) Program utilizing the Non-Targeted Areas High Cost Area Calculation (Maximum Purchase Price). The Maximum Purchase Price limits will be updated annually and posted on the HCIDLA’s website.

If the applicant (developer) sells a restricted for-sale housing unit at a price which exceeds the Maximum Purchase Price, the applicable Linkage Fee must be paid in full. Maximum qualifying income levels for potential homebuyers shall be based upon the Maximum Annual Income Limits table published annually by HCIDLA. A covenant agreement running with the land, including the equity sharing provisions required by California Government Code 65915, shall be recorded against each restricted for-sale housing unit prior to the issuance of a building permit. Upon the resale of a restricted for sale-housing unit from the initially qualified homebuyer and the reseller’s payment to the City of its initial subsidy and proportionate share of appreciation as defined by California Government Code 65915, the covenant may be terminated. The applicant shall pay any applicable covenant preparation, monitoring and termination fees required by LAMC Section 19.14. Payments and proceeds per this section, shall be deposited to the Housing Impact Trust Fund (Ordinance No. 185341).

Fiscal Impact Statement: The HCIDLA reports that there is no impact to the City’s General Fund. However, allowing for this additional exemption will likely decrease the revenue generated by the Affordable Housing Linkage Fee and may reduce the City’s ability to fund additional affordable housing units. The HCIDLA is currently preparing the AHLF Expenditure Plan based on the current projected AHLF revenue. The following is an estimate of AHLF revenue reduction based on new units that may be accessible to middle-income first homebuyers. From 2011 to 2016, there were 2,501 building permits issued for market-rate condominiums, artist-in-residence lofts, single-family attached homes, and modest single-family detached homes over 1,500 square feet and less than 2,500 square feet – all of which are currently required to pay the linkage fee. If all of these projects filed for this new AHLF exemption at the maximum current $15 per square foot fee, the City could lose an estimated $17 million per year in lost AHLF revenue into the Housing Impact Trust Fund.

Inclusionary Housing Requirements / Central City West Specific Plan / Phased Implementation

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to including additional provisions of inclusionary housing requirements within the Central City West Specific Plan.

Recommendation for Council action, pursuant to Motion (Cedillo – Huizar):

INSTRUCT the Department of City Planning (DCP), in consultation with the City Attorney, to prepare and present an Ordinance to include in the Central City West Specific Plan the following additional provisions:

For the first 120 days following the effective date of this Ordinance, no inclusionary housing requirement under Section 11.C of the Specific Plan shall be imposed on any rental housing project for which a Building Permit Application or complete planning or zoning entitlement application has been or is submitted; for purposes of this Ordinance, a complete planning or zoning entitlement application is an application that has been accepted by the DCP and for which the application fees have been paid or for which a Vesting Tentative Tract Map has been filed and has been deemed complete; if an Applicant submitted a Building Permit Application or a complete planning or zoning entitlement application for a development project, that development project shall not be subject to the re-established Specific Plan Section 11.C.
An applicant for a rental housing project that is subject to Specific Plan Section 11 .C who submits a Building Permit Application or a complete Planning or zoning entitlement application (whichever is first):

a. 121 days following the effective date of this Ordinance shall be required to provide one-third of the total affordable requirement or in lieu payment specified under Specific Plan Section 11.C.
b. 306 days after the effective date of this Ordinance shall be required to provide two-thirds of the total affordable requirement or in lieu payment specified under Specific Plan Section 11.C.
c. 485 days or more after the effective date of this Ordinance shall be required to provide the total affordable requirement or in lieu payment specified under Specific Plan Section 11.C.

An applicant for a rental housing project that is subject to the Affordable Linkage Fee Ordinance under the Los Angeles Municipal Code Section 19.18 may elect to pay the Affordable Housing Linkage Fee in lieu of complying with the inclusionary housing requirements of Section 11.C of the Specific Plan; an Applicant shall pay a cash deposit, as determined by the DCP, which shall collect and remit the deposited amount to the City Treasurer for deposit into the Central City West Housing Fund, as established by Article 23, Section 5.115.6 of the Los Angeles Administrative Code.
For the purpose of determining the required set aside under Specific Plan Section 11 .C, dwelling units with the Project shall have the same meaning as the term as total units or total dwelling units in Government Code Section 65915(b)(3).
For the purpose of compliance with Specific Plan Section 11.C’s set aside requirement, an eight percent Very Low Income set aside may be provided as an alternative to a 15 percent Low Income set aside.

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to the definition of remodel and the distinction in rules for a demolition.

Recommendations for Council action, pursuant to Motion (Koretz – Ryu – O’Farrell):

INSTRUCT the Department of City Planning (DCP), with the assistance of the Los Angeles Department of Building and Safety (LADBS), in consultation with the City Attorney and all relevant departments, to prepare a report that highlights the differences between a remodel and a demolition project in current code, the option to re-define remodels as those that maintain at least 50 percent of an original structure in order to maintain any non-conforming rights, improve notification requirements to neighbors, and review all applicable building loopholes in the City’s codes that may negatively impact neighbors.

INSTRUCT the DCP, with the assistance of the LADBS, in consultation with the City Attorney and all relevant departments, to include in the report Best Practices for Demolition and options the City could adopt to minimize impacts to neighbors, including: a) timely and adequate notification to neighboring properties; b) dust mitigation; c) noise mitigation; d) construction street parking; and e) other impacts and complaints received by the City.

Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.

REQUEST the Board of Public Works to report on: The progress on tree replacement and planting six months after instituting the in-lieu fee. The tree replacement ratio, including not just a 2 to 1 ratio, but possible equivalents in replacement trees accounting for canopy size of the removed mature tree. Alternatives to allow for more flexibility in the distribution of the trees throughout the City. The creation of a detailed plan to accompany the aforementioned Ordinance for future tree planting, covering planting locations (e.g., streets and parks), quality of trees, and a timeline to ensure the right tree is in the right place. A long-term tree monitoring system.
