Affordable Housing Linkage Fee Update – July 1, 2019

The Affordable Housing Linkage Fee (AHLF) Ordinance (No. 185,342) was adopted by the City Council on December 13, 2017, establishing a fee on certain new market-rate residential and commercial development to generate local funding for affordable housing. The City Council subsequently adopted the fee schedule by resolution on June 29, 2018. LAMC Section 19.18 C.3(a) specifies that the fee schedule will be adjusted annually for inflation beginning on July 1,2018 using the latest change in the Consumer Price Index for all urban consumers (CPI-U) for the Los Angeles-Riverside-Orange County area, or if such an index ceases to be published, by an equivalent index chosen by the Director. In January 2018, the Bureau of Labor Statistics introduced a new geographic sample for the CPI that utilizes separate indexes for Los Angeles and Riverside. Therefore, the AHLF annual inflation adjustment is based on the CPI-U for the Los Angeles-Long Beach-Anaheim Area.

Home Sharing Ordinance – Registration

City Planning Online Registration

Beginning July 1, 2019, hosts will be able to start registering for home-sharing in the City of Los Angeles.

Hosts who are currently operating will have until October 31, 2019, to register before the City would begin enforcement. Hosts can register at any time during the July 1 to October 31, 2019 period.

In December 2018, the City Council adopted the Home-Sharing Ordinance (CF 14-1635-S2), establishing a regulatory framework to restrict short-term rentals to one’s primary residence, in order to prevent the wholesale conversation of homes into rental properties. The Home-Sharing Ordinance requires hosts who wish to engage in short-term rentals to register with the City and post their registration number on all advertisements. Hosts must adhere to all requirements and must use the online portal to register.

Interim Control Ordinance (ICO) / Crenshaw Corridor Specific Plan

Motion (Harris-Dawson – Koretz) relative  to instructing the Department of City Planning, in consultation with the City Attorney, to prepare and present an Interim Control Ordinance (ICO), to prohibit the issuance of demolition, building, grading, and other applicable permits in C2 zones, where the property is located immediately adjacent to a R1 or more restrictive zone, fronts a Local Street, that has a lot width of 55 feet or less; and, additional instructions to include an urgency clause making the ICO effective upon publication, and consistent with California Government Code Section 65858, the ICO to run for 45 days, with a 10 month and 15 days extension by Council Resolution, which can be further extended for an additional year, or until the adoption of the appropriate land use regulatory and design provisions has been approved by the Department of City Planning, adopted by the Council and become effective, whichever occurs first.

COMMUNICATION FROM THE CHIEF LEGISLATIVE ANALYST (CLA) and RESOLUTION (KORETZ – SMITH) relative to establishing the City’s position regarding Senate Bill (SB) 58 (Wiener) which would authorize select California cities to issue an additional hours license to an on-sale licensee allowing alcohol sales at the licensed premises between the hours of 2 a.m. and 4 a.m.

Recommendation for Council action, SUBJECT TO THE CONCURRENCE OF THE MAYOR:

RESOLVE to include in the City’s 2019-20 State Legislative Program, OPPOSITION for SB 58 (Wiener) which would authorize select California cities to issue an additional hours license to an on-sale licensee allowing alcohol sales at the licensed premises between the hours of 2 a.m. and 4 a.m.

Fiscal Impact Statement: None submitted by the CLA. The City Administrative Officer has not completed a financial analysis of this report.

On July 11, 2019, the Mayor’s Office asked the Personnel Department to review DCP’s request.  …

Based on my review of the Department of City Planning’s request, as well as the review of the Personnel Department, I hereby approve the request for the exemption of one Principal City Planner and transmit my action to the City Council, pursuant to City Charter Section 1001(b)(1). If the exempt position is not filled within six months, the Mayor’s approval for the department to fill the position may expire.
