East San Fernando Valley Transit Neighborhood Plan

 

Dear Community Members,
Last year, Los Angeles City Planning launched the East San Fernando Valley Transit Neighborhood Plan (ESFV TNP) in anticipation of the new Metro light rail train that is coming to Van Nuys Boulevard. The ESFV TNP is a multi-year work program that will apply new land use designations and zoning regulations about a half-mile around the train route, specifically within portions of the Pacoima, Arleta, and Panorama City communities. The purpose of proactively updating land use and zoning along the corridor is to ensure that new developments arising as a result of the light rail project will bring equitable housing opportunities for the community, support transit ridership and mobility access, and advance economic vitality in the region.
Where We’ve Been
The ESFV TNP program involves opportunities for public participation at every phase of the process. Initial community outreach and engagement for the ‘Listen’ phase of the work program began in Fall 2023. As part of this phase of engagement, the ESFV TNP team has been spreading awareness about the program, building relationships with local organizations, and sharing educational materials to afford community members the foundational knowledge needed to meaningfully participate in the planning process.
Last year, the ESFV TNP team conducted various engagement activities as part of the ‘Listen’ phase of the work program. Staff visited local Neighborhood Councils, tabled at community events, guest taught a land use and zoning class at Pacoima Beautiful’s People’s Collaborative Academy, and presented to students in CSUN’s Political Science Student Association. We appreciated every opportunity to engage with community members and look forward to future engagements with other community groups.
What’s Happening Next
As part of the ongoing ‘Listen’ phase, the ESFV TNP team will continue to collaborate and engage with stakeholders to understand the community’s needs, priorities, and vision for the future development of their neighborhood. The team will utilize all of the feedback heard as they proceed to draft land use maps, which are tentatively scheduled to be released for public review by Winter 2024-2025.

Metro’s Transportation Communication Network

The proposed Metro Transportation Communication Network (TCN) Ordinance will be considered by the Planning and Land Use Management (PLUM) Committee of the City Council on Tuesday, November 7, 2023. The PLUM Committee meeting follows the City Planning Commission hearing held on September 14, 2023. At the direction of the Los Angeles City Council, Los Angeles City Planning has prepared ordinances to amend the Zoning Code to allow the Los Angeles County Metropolitan Transportation Authority (Metro) to implement a TCN (Council File: 22-0392). Metro is proposing to erect digital display signs on Metro-owned parcels throughout the City that are adjacent to certain freeways and major streets as part of its TCN program. The proposed ordinances, known collectively as the Metro TCN Ordinance, will create a new Supplemental Use District (SUD) and include a Zone Change to apply the TCN SUD and its regulations to specific parcels owned by Metro. The PLUM Committee meeting will provide another opportunity for the public to share their feedback and comments on the proposed Metro TCN Ordinance and project. PROJECT SITE: The Proposed Transportation Communication Network (TCN) Supplemental Use District (SUD) is dispersed Citywide on 49 parcels owned by the Los Angeles County Metropolitan Transportation Authority (Metro). The parcels can be contiguous and non-contiguous and are predominately adjacent to freeways and major roads within the City including, but not limited to, the 2, 5, 10, 90, 110, 101, 118, 170 and 405 freeways. The TCN SUD includes individual parcels in the communities of Atwater Village, Boyle Heights, Downtown, Echo Park, Encino, Glassell Park, Granada Hills, Hollywood, North Hollywood, Pacoima, Palms, Sherman Oaks, South LA, Sun Valley, Sylmar, Van Nuys, West LA, and Westchester.

PROPOSED AMENDMENT: A code amendment amending Sections 12.32 and 13.00 and establishing Section 13.11.1 of Chapter 1, and a parallel edit to establish a new Section in Article 8 of Chapter 1A, of the Los Angeles Municipal Code (LAMC) to create a new “Transportation Communication Network,” or “TCN,” Supplemental Use District (SUD), and a Zone Change to apply the TCN District and its regulations and permissions to specific properties owned by Metro within the City. The TCN SUD will permit Metro to install sign structures, including digital display signs, on up to 49 properties owned by Metro. The ordinance proposes specific operational standards, location restrictions, and maintenance requirements for the structures and digital displays. The TCN SUD incorporates a required program for the removal of existing static off-site signs both on Metro owned property and private property resulting in a net reduction in off-site signage within the City. The TCN SUD ordinance details these regulations and requirements, and identifies the Metro owned properties subject to the provisions of the ordinance.

REQUESTED ACTIONS:

1. Find, based on the independent judgment of the decision maker, after consideration of the whole of the administrative record, the Project was assessed in the previously certified Environmental Impact Report No. ENV-2022-5286-EIR (State Clearinghouse No. 2022040363), certified by the Los Angeles County Metropolitan Transportation Authority (Metro) Board of Directors on January 26, 2023; and pursuant to CEQA Guidelines, Sections 15162 and 15164 and the Addendum, dated August 2023, that no major revisions to the EIR are required and no subsequent EIR or negative declaration is required for approval of the Project;
2. Approve and Recommend that the City Council adopt the proposed Ordinance with staff’s proposed modifications listed in the Staff Recommendation Report incorporated into the Ordinance;
3. Approve and Recommend that the City Council adopt the Zone Change (Exhibit E) to permit the establishment of a non-contiguous Supplemental Use District, called the Transportation Communication Network, on property owned by Metro with staff’s proposed modifications listed in the Staff Recommendation Report incorporated into the Ordinance;
4. Adopt the Staff Recommendation Report as the Commission’s Report on the subject; and
5. Adopt the Findings.

The CPC meeting follows the Public Hearing held on July 12, 2023. The Staff Recommendation Report to the CPC is now available to the public. The Report includes a revised draft Metro TCN Ordinance along with exhibits that include further details and renderings related to the proposed TCN sign structures and digital displays.
At the direction of the Los Angeles City Council, Los Angeles City Planning has prepared two ordinances to amend the Zoning Code to allow the Los Angeles County Metropolitan Transportation Authority (Metro) to implement a TCN (CF 22-0392).

The CPC meeting is an opportunity for stakeholders and the general public to share feedback with the CPC on the proposed Metro TCN Ordinance. The CPC may take an action at the meeting to make a recommendation to the City Council on the proposed ordinance. No final decision will be made at this meeting, and subsequent consideration by the City Council must occur before adoption of the ordinance. Los Angeles City Planning prepared and released a draft ordinance on June 14, 2023, followed by a staff-level public hearing held on July 12, 2023 to receive public comment on the draft ordinance. On August 31, 2023, Los Angeles City Planning released a revised draft ordinance, along with the staff recommendation report, to address concerns raised during the public comment period.

The report should rely on best practices from other jurisdictions and include recommendations for urban design standards consistent with the Citywide Design Guidelines for pedestrian design, 360­-degree design, and climate adaptive design that promote a high quality pedestrian environment and improve interactions with the public realm.

DCP, State Housing Update

On September 22, 2022, the Governor signed Assembly Bill (AB) 2097, which added Government Code Section (§) 65863.2. AB 2097 prohibits a public agency from imposing or enforcing any minimum automobile parking requirement on any residential, commercial, or another development project that is within one-half mile of a Major Transit Stop, with minor exceptions detailed below. A development project, for purposes of this bill, includes any project requiring a discretionary entitlement or building permit to allow the construction, reconstruction, alteration, addition, or change of use of a structure or land.

In Los Angeles, City Planning is responsible for overseeing the implementation of AB 2097, in accordance with State law. Consult DCP webpage for eligibility requirements or email City Planning at planning.ab2097@lacity.org with general questions on project eligibility and review.

This memo will serve as guidance for staff and project applicants on the implementation of AB 2097 for discretionary and ministerial projects until the time this memo is superseded. Staff and interested parties are encouraged to refer to state law in Government Code §65863.2 for additional information as this memo is not exhaustive.

Key Provisions

Eligibility:  To assess whether a parcel is eligible to qualify under AB 2097, consult the Department’s Zone Information and Map Access System (ZIMAS), a web-based mapping tool that provides zoning information for parcels in Los Angeles. Enter the address in the pop-up window, click the “Planning and Zoning” menu on the left side of the screen, and then scroll down to the “AB 2097 Eligibility” field.

Projects located within a half-mile of a major transit stop are generally eligible for the automobile parking reduction provided by AB 2097. This includes residential, commercial, and industrial projects, but does not include hotels, motels, bed and breakfast inns, or other transient lodgings. The State does give local agencies the option to impose minimum parking requirements in limited instances, provided that one of the following three findings can be substantiated in the affirmative to necessitate minimum parking requirements:

  • The project furthers the City’s ability to meet its share of the Regional Housing Needs Assessment (RHNA) for low and very low-income households,
  • The project directly supports the City’s ability to meet any special housing needs for the elderly or persons with disabilities; or,
  • The project is located within one-half mile of existing residential or commercial parking.

Note: These findings must demonstrate that the project would have a substantially negative impact, should the City not impose or enforce minimum parking requirements.

The State law offers a 30-day timeline to formally invoke such findings. However, these findings may not be made for projects that meet the following criteria:

  • Projects that reserve 20% or more of the total dwelling units for very low, low, or moderate-income households, students, the elderly, or persons with disabilities,
  • Projects that contain fewer than 20 dwelling units; or,
  • Projects that are subject to other parking reductions of any other applicable law (by satisfying the applicable eligibility requirements).

 

Livable Communities Initiative / Transit-Rich Corridors / Analogous Citywide Regulations / Mid-Scale Development

CF 21-1230-S2      AT CITY COUNCIL 12/07/2022

HOUSING, TRANSPORTATION, AND PLANNING AND LAND USE MANAGEMENT COMMITTEES’ REPORT relative to establishing the Livable Communities Initiative (LCI), identified as Program 131 of the City’s 2021-2029 Housing Element, along suitable transit-rich corridors.

Recommendations for Council action, pursuant to Motion (Bonin – Raman – Harris-Dawson – de León – Krekorian):

1.DIRECT the Department of City Planning (DCP), with assistance from the Los Angeles Department of Building and Safety, Los Angeles Department of Transportation (LADOT), and other relevant City departments, to report to the Council within 180 days with strategies to establish the LCI along suitable transit-rich corridors, or analogous Citywide regulations, that facilitates mid-scale development, promotes the creation of housing units where they do not currently exist, and creates or enhances existing commercial, mixed-use character. As part of its report, the DCP should consider by-right or administrative development and zoning standards to encourage mid-scale development; including, but not limited to:

Waivers or reductions of setback, unit floor area, and other development standards.

An inclusionary housing requirement to increase access to affordable housing.

A minimum density requirement to promote multifamily, mixed-use development.

Provisions to encourage greater lot density such as allowing for microunits, shared housing, or increasing floor area ratio allowances.

The elimination or reduction of parking minimums in “high quality transit areas” or “transit-rich areas”.

Exclusions and/or mitigations for lots located within a Very High Fire Hazard Severity Zone, an identified historic district, or are designated as open space.

Exclusions for projects that may result in the demolition of buildings subject to the Rent Stabilization Ordinance or the loss of covenanted affordable units.

2.DIRECT the DCP, as part of this report to the Council, to develop a community-driven outreach and engagement strategy that will assist in informing the necessary maps and reports required to identify suitable transit-rich corridors that would benefit from the LCI and complement existing rezoning efforts through the implementation of the Housing Element (2021-2029). This strategy should demonstrate adequate engagement and involvement with marginalized, historically underserved, and/or disadvantaged communities potentially impacted by the selection of suitable corridors.

3. DIRECT the DCP, in coordination with the DCP’s Urban Design Studio, to report to the Council within 180 days on options for an administrative clearance procedure for projects eligible for the LCI that outlines objective Design and Development Standards to ensure high quality, contextual design and compatibility with the vision of the LCI outlined in Program 131 of the Housing Element (2021-2029).

4. DIRECT the DCP, LADOT, Department of Public Works, and the Economic Workforce Development Department (EWDD), with assistance from the City Administrative Officer (CAO) and other relevant City departments, to report to the Council within 180 days with options to establish a streamlined, administrative review process that ensures projects eligible for the LCI invest in public right-of-way amenities and infrastructure improvements in order to encourage transit ridership, pedestrian and cyclist safety, and placemaking.

5. DIRECT the EWDD and the CAO, with the assistance of the DCP, Chief Legislative Analyst (CLA), and other relevant City departments, to report to the Council within 180 days on the feasibility of any new regulatory tools, fees, grants, and/or strategies that can help fund substantial public improvement projects along corridors identified by the LCI; including, but no limited to: Social Impact Bonds, Community Revitalization and Investment Authorities, and/or Enhanced Infrastructure Financing Districts.

Transportation Demand Management (TDM) Program Update

On September 22, the City Planning Commission (CPC) recommended approval of the City’s Transportation Demand Management Ordinance update. Managed by City Planning and the Los Angeles Department of Transportation (LADOT), the updated ordinance aims to reduce dependence on drive-alone commuting in Los Angeles, improve air quality, and reduce greenhouse gas emissions.

Furthermore, the ordinance increases transportation options and accessibility throughout the City, and allows flexibility for future changes to transportation technology and services. It expands the number of new projects that are required to implement strategies such as supporting transit, telecommuting, carshare, and neighborhood shuttles, as well as other strategies that reduce vehicle trips and support general public health benefits.

Metro’s Transportation Communication Network

 

Dear Angelenos:
On June 28, 2022, the Los Angeles City Council adopted a motion (CF 22-0392) instructing Los Angeles City Planning to draft an amendment to the Zoning Code to permit digital signage related to Los Angeles County Metropolitan Transit Authority’s (Metro) Transportation Communication Network (TCN). Metro’s TCN program would erect freestanding signs with digital displays at 56 locations throughout the City. These signs would incorporate various intelligent transportation technologies to help manage traffic, provide real-time traffic and transit information, display Metro service alerts and public emergency messaging, and permit off-site advertising for revenue generation to support local transportation projects in the City. Metro’s project website can be found at metro.net/tcn, and details on Metro’s proposed site locations can be found here.
As part of this project, the City entered into a memorandum of agreement (MOA) with Metro in early 2022 to share any revenue generated from the off-site advertising on these signs for 20 years. This agreement (C-139852) outlines how the shared revenue will be allocated and puts restrictions on how and where these funds may be spent by the City. Any revenue generated from this agreement must be spent on transportation projects or to support new transportation infrastructure. The funds will be overseen by the City’s Department of Transportation.
As part of the MOA, the City will need to amend the Zoning Code to allow the TCN signs and associated off-site advertising, and a full environmental review will be completed. The environmental review process is underway and is being led by Metro. A draft environmental impact report (DEIR) has been completed by Metro, and is now available for public comment until Monday, October 24, 2022, at 5 p.m. The document may be found here, and public comments may be submitted by email to tcn@metro.net. It should be noted that the City is not the lead agency on this environmental document, but a responsible agency, and all DEIR comments must be submitted to Metro.
As part of its preparation for drafting the necessary Zoning Code amendment to permit the TCN program, City Planning will be holding virtual office hours for the public to discuss the project in further detail and obtain feedback on the project’s components, design, and operations. These virtual office hours will be held during late September and mid-October. Office hour appointments are 20 minutes and will take place over the phone or through video conference, according to your preference. Please note that video conferencing will also allow screen-sharing of materials.

Transportation Demand Management (TDM) Program Update

Earlier this month, LA City Planning and LA Department of Transportation released revised drafts for the proposed Transportation Demand Management (TDM) Program update for public review and comment. A virtual Open House & Public Hearing is scheduled for Tuesday, August 2, 2022 at 4:00 p.m.
The proposed TDM Program update aims to reduce the need for drive-alone vehicle trips by increasing transportation options and accessibility throughout the City, providing benefits to the environment and public health. It would require new development projects over a certain size to implement strategies such as supporting transit, telecommuting, walking, carshare, and other sustainable travel options that reduce vehicle trips. This effort is part of the city’s implementation of the Mobility Plan 2035.
The revised drafts of the TDM Ordinance and TDM Program Guidelines incorporate feedback gathered over the last several years, including through public workshops and office hours held in 2021. Among changes to the revised ordinance are adjusted project size thresholds and modified monitoring and enforcement procedures.

Action: 2022-07-19 – Chaptered by Secretary of State – Chapter 122, Statutes of 2022.

Existing law prohibits a local agency from requiring the replacement of religious-use parking spaces, as defined, that a developer of a religious institution affiliated housing development project proposes to eliminate as part of that housing development project.

Existing law prohibits the number of religious-use parking spaces requested to be eliminated from exceeding 50% of the number that are available at the time the request is made. This bill would clarify that the definition of “religious-use parking spaces” applies to both existing parking spaces and those parking spaces required of a proposed development for a new place of worship.

The bill would recast the provisions relating to the elimination of parking spaces to prohibit the number of spaces proposed to be eliminated in the case of a proposal for a newly constructed place of worship from exceeding 50% of the spaces that would otherwise be required.

The bill would also prohibit the number of spaces proposed to be eliminated in the case of an existing place of worship from exceeding 50% of the spaces that exist at the time the request is made. The bill would not preclude the enforcement of any requirement otherwise imposed on new development to provide electric vehicle supply equipment installed parking spaces or parking spaces that are accessible to persons with disabilities.

Transportation Deman Management (TDM) Program Update

LA City Planning and LA Department of Transportation are pleased to announce the release of revised drafts for the proposed Transportation Demand Management (TDM) Program update for public review and comment. A virtual Open House & Public Hearing is scheduled for Tuesday, August 2, 2022 at 4:00 p.m.
The proposed TDM Program update aims to reduce the need for drive-alone vehicle trips by increasing transportation options and accessibility throughout the City, providing benefits to the environment and public health. It would require new development projects over a certain size to implement strategies such as supporting transit, telecommuting, walking, carshare, and other sustainable travel options that reduce vehicle trips.
The revised drafts of the TDM Ordinance and TDM Program Guidelines incorporate feedback gathered over the last several years, including through public workshops and office hours held in 2021. Among changes to the revised ordinance are adjusted project size thresholds and modified monitoring and enforcement procedures.

A public hearing is a means to collect comments from stakeholders before the proposed TDM Program update is presented to the City Planning Commission for recommendation, and ultimately the City Council for adoption. A presentation will be followed by an opportunity to provide oral comments. The virtual Open House and Public Hearing is open to everyone who would like to participate. No decisions will be made at the Public Hearing.

Transportation Demand Management Update

City Planning, in collaboration with the Department of Transportation (LADOT), continues to make progress on updating the Transportation Demand Management ordinance, a citywide ordinance that will require certain new development projects and substantial building additions to implement strategies that reduce vehicle trips such as telecommuting, carshare, and providing transit passes.
Planning staff held three informational webinars and released initial drafts of the TDM Ordinance and TDM Program Guidelines for public review in June 2021. Just last month, LADOT released two promotional videos (part 1) (part 2) that provide further context for how TDM can support sustainable development and transportation options in Los Angeles, and explain the TDM Calculator’s functions.
City Planning is currently preparing to release revised draft documents incorporating recent public feedback and will hold a virtual Open House and Public Hearing in early June to solicit additional public comment before the ordinance progresses to the City Planning Commission in Summer 2022. Previous drafts of the ordinance and program guidelines, an informational video, and fact sheet are available online.

L.A. Al Fresco Program

CF – 20-1074-S1    UPDATE

Mayor Garcetti extended the L.A. Al Fresco Program until December 31, 2020 through the Safer L.A. emergency authority. LADOT has finite resources to meet increasing applicant demand for the Program and to provide ongoing equipment rental costs incurred with each new curbside dining area or closure installation. Below outlines how the Department plans to adapt L.A. Al Fresco to address this challenge and to structure the Program in a way that benefits the most restaurants while being fiscally prudent and efficient.

Coronavirus COVID-19 Emergency Declaration / Conditional Use Permit / Various Parking Requirements Suspension / Restaurant Beverage Program / Emergency Ordinance

The City Council of the City of Los Angeles (City Council) recognizes the significant public health and economic impacts of the novel Coronavirus pandemic (pandemic) on the City of Los Angeles (City), and further appreciates the need to facilitate temporary zoning code relief to support the local economy and livelihood of those living and working in the City.

The City Council further recognizes the uncertainty surrounding the current local emergency, a result of the pandemic, and the risk of subsequent local emergencies to unduly impact the local economy and employment necessitates temporary regulations.

The City Council desires to provide regulatory relief during declared local emergencies that allow for reductions in parking requirements and extensions of time for the utilization of certain land use entitlements.

The City Council intends for the relief to provide needed flexibility for businesses and projects by extending time limits for approvals and providing targeted parking relief for small scale projects, thereby allowing local proprietors to achieve cost savings while furthering the environmental and mobility goals of the General Plan;

LA City Planning and LA Department of Transportation

In August, the Transportation Demand Management (TDM) Program team presented at both the Sustainability Alliance and PlanCheck Neighborhood Councils. During both meetings, staff presented the proposed updates to the TDM Ordinance and answered clarifying questions related to those changes. An informational video is available online.
The draft ordinance would help reduce car dependence in Los Angeles and help the City meet the carbon pollution reduction goals set out in the Mayor’s Green New Deal. The proposal requires expanded TDM strategies from certain new developments, including incentives for public transit and carpooling, additional investments in biking and telecommuting programs, and making information about travel options more accessible to residents, employees, and visitors.
Feedback may be sent to the TDM team at planning.mobility@lacity.org. Later this year, an open house and a public hearing will be held in advance of the proposed ordinance being considered for adoption by the City Planning Commission and City Council.

Electric Vehicle Charging / Building Infrastructure / Alternative Compliance Pathways / Los Angeles Municipal Code / Amendment

Motion (Koretz – Blumenfield) relative to directing the Los Angeles Department of Building and Safety to submit a Code Amendment to all Los Angeles Municipal Code Sections regarding electric vehicle (EV) charging in buildings that will provide an alternative compliance pathway to meet the minimum required number of installed Level 2 chargers, provide flexibility for developers to locate conduit and stub outs in between two adjacent spaces where feasible, for spaces with no installed charger but where conduit and panel capacity are required; increase the multi-family EV ready parking space requirement from 20% to 25% to align with the County of Los Angeles, provide a reduced EV parking space requirement for certain technical hardships, provide developers flexibility relative to the parking stall size, ensuring only that parking stalls meet minimum Code requirements; and, such Code should be re-evaluated at the time of the triennial green building code update to adjust for changes in local charging needs and prevailing technologies.

Comprehensive Assessment / Streets Withdrawn from Public Use / Reinstatement Procedure

PUBLIC WORKS COMMITTEE REPORT relative to an assessment of recently reinstated hillside streets previously withdrawn from public use.

Recommendations for Council action:

INSTRUCT the Bureau of Engineering (BOE) to work with the Bureau of Street Services (BSS), the Los Angeles Fire Department, and the Los Angeles Department of Transportation (LADOT) to develop a recommended scope for a comprehensive study to assess hillside streets, and prepare a cost estimate.

DIRECT the BOE to report within 120 days with details of the recommended study scope of work and associated funding request.

Slow Streets L.A. Program / Update

Recommendations for Council action:

APPROVE the continuation of the Slow Streets L.A. Program as detailed in the LADOT report to Council dated October 15, 2020.
DIRECT the LADOT to report to Council in 90 days on the status of the Slow Streets L.A. Program.
Fiscal Impact Statement: The LADOT reports that this action will not impact the General Fund. Proposed Slow Streets L.A. Program installations are funded through $800,000 that was originally allocated to the City’s Open Streets Program. The sources of these repurposed funds are Metro grant funds, front-funded by Measure M local return funds, and City Measure M local return match funds.

The requirement in CEQA Guidelines Section 15064.3 to use vehicle miles traveled (VMT) as the metric for transportation analysis still takes effect on July 1st. The purpose of this webinar is to make this transition as easy and seamless as possible.

OPR staff will walk through OPR’s recommendations on how to implement this change and answer clarifying questions from attendees.  The webinar will cover methods of VMT analysis, determining VMT significance, and VMT mitigation for both land use and transportation projects.
Guest presenters from the City of San Jose and UC Berkeley Law’s Center for Law, Energy & the Environment will cover how their jurisdiction has implemented the VMT metric and potential mitigation strategies, respectively. Meea Kang from Related California will provide a developer’s perspective and discuss rural and small town development.
