Ventura-Cahuenga Specific Plan Amendment

Dear Stakeholders,
We hope this message finds you well. We appreciate your continued interest and engagement with the Ventura-Cahuenga Specific Plan Amendment. As we announced in August of 2021, Los Angeles City Planning will address the implementation of the New Zoning Code on the Ventura-Cahuenga Corridor as part of the Community Plan Updates underway in the Southeast and Southwest Valley.
Last week, the Southeast and Southwest Valley Community Plan Update teams each announced opportunities to engage in discussions regarding proposed land use concepts for the Ventura-Cahuenga Corridor. These initial concepts are a first step towards applying the New Zoning Code on the Corridor. We invite you to participate in these outreach efforts to share your vision for the future of this important commercial corridor in the San Fernando Valley. The Woodland Hills, Tarzana, and Encino neighborhoods are included in the Southwest Valley Community Plan Update project, and the Sherman Oaks, Studio City, and Cahuenga Pass neighborhoods are included in the Southeast Valley Community Plan Updates. Southwest Valley Community Plans Update
On May 18, City Planning released updated draft land use designations for the following Community Plans:
  • Canoga Park-Winnetka-Woodland Hills-West Hills
  • Encino-Tarzana
  • Reseda-West Van Nuys-Lake Balboa
Accompanying these drafts are a StoryMap that presents the proposed changes in detail and a three-part video series explaining the background and aims of the new proposals. The updated proposals include a discussion on the initial vision and concepts around planning for the future of the Ventura-Cahuenga Boulevard Corridor.
The Southwest Valley Community Plans Update team will host virtual office hours from June 1 through June 18. We would love to hear your thoughts on how to shape your community for the future. Los Angeles City Planning issued memorandums on Senate Bill (SB) 9. In addition to SB 9, SB 290, SB 728, Assembly Bill (AB) 634, and SB 478

Read: DCP Memo IMPLEMENTATION OF STATE DENSITY BONUS LAWS – SB 290, SB 728, AB 634 (2021),  May 20, 2022 

Dear Stakeholder:

As State legislation is adopted or revised, the City issues local implementation guidance as needed. Earlier this year, Los Angeles City Planning issued memorandums on Senate Bill (SB) 9. In addition to SB 9, SB 290, SB 728, Assembly Bill (AB) 634, and SB 478 all took effect on January 1, 2022. The bills expand State Density Bonus incentives for student and moderate-income housing, authorize the purchase of for-sale units by a qualified nonprofit, address jurisdictions’ ability to increase covenant terms beyond 55 years, and permit Floor Area Ratio (FAR) increases in low-density multi-family neighborhoods and commercial corridors.

City Planning has prepared two memorandums for the local implementation of these laws. The first memorandum includes SB 290, SB 728, and AB 634 and describes the changes, clarifications and additions to State Density Bonus Law. The second memorandum focuses on SB 478 and summarizes FAR allowances for sites permitting a density between three and ten units and clarifies minimum lot size requirements. Both memorandums will serve as interim guidance for staff and project applicants regarding the implementation of bills until the City’s Density Bonus Ordinance is updated or these memorandums are otherwise superseded.
Key Provisions and Restrictions
Note: Included below is a partial list of provisions and restrictions. Please consult the memorandum for detailed instructions.

Density Bonus Memorandum

SB 290

Allows one Density Bonus incentive or concession for student housing developments when the development contains at least 20% of the units for Lower-Income Students;
Reduces parking requirements for housing with at least 40% Moderate-Income units within one half-mile of a major transit stop to 0.5 parking spaces per bedroom;
Removes findings of a “specific adverse impact on the physical environment” as a basis for denial of a Density Bonus concession, incentive, or waiver; and
Clarifies definitions.

SB 728

Authorizes a qualified nonprofit housing corporation to purchase a for-sale unit created through Density Bonus.

AB 634

Clarifies that State law does not preclude the adoption of a local ordinance that requires affordability terms beyond 55 years.

SB 478 Memorandum

Provides minimum statewide standards on Floor Area Ratio (FAR) and minimum lot sizes for housing development projects of three to ten units on land zoned for multi-family or mixed-uses, commonly known as “missing middle” housing. Specifically, for eligible projects, the bill provides that local jurisdictions may not:

  1. Impose a FAR standard that is less than 1.0:1 for an eligible housing development project consisting of three to seven units,
  2. Impose a FAR standard that is less than 1.25:1 for an eligible housing development project consisting of eight to ten units,
  3. Deny an eligible housing development project located on an existing legal parcel solely on the basis that the lot area of the proposed lot does not meet the local agency’s requirements for minimum lot size, and
  4. Impose any other lot coverage requirements that would physically preclude a qualifying project from achieving the permitted FAR described above.

Restaurant Beverage Program (RBP) Ordinance (No. 187,402)

Dear Interested Parties,
On May 10, 2022, the City Council’s Planning and Land Use Management (PLUM) Committee approved seven proposed Resolutions relative to activating the provisions of the Restaurant Beverage Program (RBP) Ordinance (No. 187,402).
As such, on Wednesday, May 25, 2022, the full City Council will consider three of the seven proposed Resolutions (Council Districts 2, 4, and 15). You can find each resolution, along with its attached maps and findings for each resolution in the agenda for this meeting. The remaining four resolutions will be considered at a later date.
On February 9, 2022, the City Council voted unanimously to adopt the RBP Ordinance, which creates two versions of the RBP, a general and an Alcohol Sensitive Use Zone (ASUZ) version, for sit-down restaurants to serve alcohol if they meet more than 50 eligibility criteria, performance standards, and enforcement procedures. The ASUZ version contains additional standards, including a one-year provisional period with a complaint portal review. The RBP Ordinance became effective on March 31, 2022, and is available here.
To participate in either version, a qualifying restaurant must be located in a neighborhood that has been identified as eligible by the City Council. The RBP Ordinance requires the City Council to designate specific geographic areas by City Council Resolution in order to activate either the general or sensitive use provisions of this ordinance.

IMPLEMENTATION OF SB 478 (2021)

Read:  DCP Memo, May 20, 2022 

On September 28, 2021, the Governor signed Senate Bill (SB) 478, also known as the Housing Opportunity Act. The bill adds Government Code Sections (§) 4747 and 65913.11 and amends Housing Element Law at Government Code §65585 to include a number of changes and clarifications. SB 478 will enable the construction of multi-family units in zones where restrictions on Floor Area Ratio (FAR) and minimum lot size restrict their development.

This memo will serve as interim guidance for staff and project applicants on the implementation of SB 478 until the time this memo is superseded. Staff and interested parties are encouraged to refer to state law in Government Code §4747, §65585, and §65913.11 for additional information, as the memo is not exhaustive.

The webinars will share the draft land use concepts for the Ventura-Cahuenga Boulevard Corridor in the Sherman Oaks, Studio City, and Cahuenga Pass neighborhoods. These concepts are the initial vision for how the corridor will grow and change over the next 20 years, and we want to hear from you. Join us to hear the latest on the project, and make your voice heard!
During the month of June, the Southeast Valley Team will be hosting three webinars sharing proposed land use concepts for the corridor, followed by Q&A sessions to collect your feedback. Your input will inform the changes proposed through the Community Plan Updates. Join us to:

Today, Los Angeles City Planning is releasing updated draft land use designations for the three Community Plans of the Southwest Valley:
Canoga Park-Winnetka-Woodland Hills-West Hills,
Encino-Tarzana, and
Reseda-West Van Nuys-Lake Balboa.
You can explore the proposed land use designations in detail via the online StoryMap. The StoryMap tool is a guided experience that contains interactive maps and online feedback forms to make it easy for you to review the proposed content and share your comments.
As part of this release, the Southwest Valley team has developed a three-part video series to provide background information and answer questions you may have regarding the Community Plans Update.
The Video Series
Part One provides an introduction to the Community Planning process and the City’s new Zoning Code, gives an overview of the Southwest Valley geography, and discusses changes to the boundaries of the Community Plans as well as the introduction of the Ventura Corridor as part of the Community Plans Update process.
Part Two focuses on the vision for the Southwest Valley Community Plans Update and discusses the strategies behind the newly proposed land use designations for achieving this vision.
Part Three focuses on the Ventura-Cahuenga Boulevard Corridor Specific Plan, discussing its place within the overall Community Plans Update process and future possibilities for the specific plan area.

The General Plan Housing Element update for the 6th cycle (2021-2029) was adopted by the City
Council on November 24, 2021. The Project proposes a General Plan Amendment to make
targeted amendments to the adopted Housing Element, including the modification and addition of
implementation programs in Chapter 6 to clarify metrics, milestones, actions, and strategies to
affirmatively further fair housing as well as expand place-based programs to encourage community
revitalization; and the correction of formatting and typographical errors.

REQUESTED ACTIONS:

1. Conduct a public hearing on the Project, as described in this Staff Recommendation Report;
2. Approve the Staff Recommendation Report as the Commission Report;
3. Approve and Recommend that the City Council adopt the Findings in the Staff
Recommendation Report;
4. Recommend the City Council find, based on their independent judgment, after consideration of the whole of the administrative record, including the 2021-2029 Housing Element EIR, SCH No. 2021010130, certified on November 24, 2021 (EIR) and the Addendum prepared for the Proposed Project (Addendum) (Exhibit C), the Project was assessed in the EIR and pursuant to the CEQA Guidelines, Sections 15162 and 15164 and the Addendum, that no major revisions to the EIR are required and no subsequent EIR, supplemental EIR, or negative declaration is required for approval of the Project;
5. Approve and Recommend that the Mayor approve and the City Council adopt the Resolution in Exhibit A to amend the Housing Element of the General Plan, as shown in Exhibit B;
6. Authorize the Director of Planning to present the Resolution (Exhibit A) and General Plan
Amendment (Exhibit B) to the Mayor and City Council, in accordance with City Charter Section 555 and LAMC Section 11.5.6.; and
7. Adopt a Resolution (Exhibit F) pursuant to City Charter Sections 559 and 560 to delegate
authority to the Director of Planning to review and make recommendations on behalf of the
City Planning Commission for future technical or targeted modifications by the City Council to the City Planning Commission’s recommendation on Resolution (Exhibit A) and General Plan Amendment (Exhibit B), or other targeted amendments to the 2021-2029 Housing Element of the General Plan, until such time as the City obtains a finding by HCD that the 2021-2029 Housing Element substantially complies with all statutory requirements for the sixth revision of the City’s Housing Element.

Revised Draft Wildlife Ordinance Now Available

Dear Wildlife Stakeholders and Interested Parties,

City Planning is pleased to announce the release of the Revised Draft Wildlife Ordinance for public review and feedback. The Revised Draft Wildlife Ordinance aims to promote wildlife habitat and connectivity within the Santa Monica Mountains between the 405 and 101 freeways, with the overall goal of maintaining essential habitat and wildlife corridors for animals and plants that are important to LA’s urban ecosystem.

The revised ordinance incorporates community feedback gathered over the last several years, including public comment that was received after the initial release of the ordinance. Among changes in the revised ordinance, City Planning determined that the most holistic way to protect ridgelines is to address them within the Wildlife Ordinance, rather than creating an independent Ridgeline Ordinance. By consolidating ridgeline protection efforts into the Wildlife Ordinance, City Planning has incorporated ecological, biological, and environmental resource considerations and will be applying them uniformly across ridgelines within the Wildlife Ordinance District.

The Revised Draft Wildlife Ordinance refines concepts developed in the previous draft (released in 2021) making the ordinance simpler and more straightforward to implement. The Revised Draft Wildlife Ordinance includes updated regulations to minimize grading and disturbance to soil and native vegetation and offers simplified standards for fencing, lighting, and setbacks, among other protections. Updated resource and ridgeline maps, as well as an address searchable interactive map, are now also available.

The Revised Draft Wildlife Ordinance is the product of extensive outreach and coordination with stakeholders, wildlife experts, and implementing Departments of the City of Los Angeles. The release of the revised draft will be followed by public hearings in the summer of 2022 and additional opportunities for public comment.
