CONSIDERATION OF MOTION (KORETZ – HUIZAR, ET AL.) relative to creating a Wildlife Corridor in the eastern area of the Santa Monica Mountains (Hillside Ordinance Zone).

The City Attorney’s Office is now reviewing the Wildlife Ordinance. Once form and legality review is complete, it will go to the full City Council for consideration in the coming months. Additionally, at the direction of the PLUM Committee, City Planning has been instructed to provide a report of staffing resources required to implement the ordinance. City Planning and Council Districts 4 and 5 have prepared new fact sheets about the ordinance.

Metro’s Transportation Communication Network

Dear interested parties,
The City Planning Commission (CPC) hearing for the proposed Metro Transportation Communication Network (TCN) Ordinance on August 17, 2023 has been canceled due to a lack of quorum and, therefore, no meeting will occur on that date. The ordinance has been tentatively rescheduled for CPC consideration on September 14, 2023. Public comment, for consideration in the staff recommendation report, will continue to be taken until August 22, 2023 at 4 p.m.
At the direction of the Los Angeles City Council, Los Angeles City Planning has prepared two ordinances to amend the Zoning Code to allow the Los Angeles County Metropolitan Transportation Authority (Metro) to implement a TCN (CF 22-0392). Metro is proposing to erect digital display signs on up to 49 Metro-owned parcels throughout the City that are adjacent to certain freeways and major streets as part of its TCN program. The proposed ordinances, known collectively as the Metro TCN Ordinance, will create a new Supplemental Use District (SUD) and include a Zone Change to apply the TCN SUD and its regulations to specific parcels owned by Metro.
Los Angeles City Planning prepared and released a draft ordinance on June 14, 2023, followed by a staff-level public hearing held on July 12, 2023 to receive public comment on the draft ordinance. The draft ordinancefact sheet, maps, and more information can be found on the project website.
Los Angeles City Planning will keep stakeholders informed about the upcoming CPC hearing through future communications and on the project website. The agenda for the CPC meeting will be available at planning4la.org/about/commissions-boards-hearings and includes instructions for submitting comments directly to the CPC. Please include Planning Case Numbers CPC-2022-5401-CA and CPC-2023-3653-ZC and Environmental Case Number ENV-2022-5286-EIR with your comment.
The CPC meeting is an opportunity for stakeholders and the general public to share feedback with the CPC on the proposed Metro TCN Ordinance. The CPC may take an action at the meeting to make a recommendation, either for approval or disapproval, to the City Council on the proposed ordinance. No final decision will be made at this meeting, and subsequent consideration by the City Council must occur before adoption of the ordinance. We invite you to attend the CPC hearing and participate in the public process.

Wildlife Ordinance

Dear Interested Parties,
Thank you for your continued interest in the Wildlife Ordinance. On June 20, 2023, the proposed Wildlife Ordinance was considered by the City Council’s Planning and Land Use Management (PLUM) Committee. The PLUM Committee unanimously voted to approve the proposed Wildlife Ordinance with some additional modifications. The Wildlife Ordinance is currently being reviewed by the City Attorney’s Office. Following the conclusion of this review, the Wildlife Ordinance is anticipated to be scheduled for consideration by the full City Council in the coming months. Additionally, the PLUM Committee instructed City Planning to report back with the final ordinance on topics including identifying the staff resources required to implement the proposed ordinance. More information about the actions taken at the PLUM Committee meeting can be found in Council File 14-0518.
To provide additional clarity, City Planning has prepared a new fact sheet to provide even further details about the proposed ordinance. In addition to this fact sheet, Council District Offices 4 and 5 released a fact sheet detailing what the ordinance does and does not propose to regulate and where the ordinance stands in the adoption process.

SB 423 Streamlined housing approvals: multifamily housing developments.

An act to amend Section 65913.4 of the Government Code, relating to land use.  Under SB 423, all of the provisions of SB 35 will be extended to 2036, and will also be expanded to more completely cover mixed-income housing developments. If passed and signed into law, SB 423 will require that cities approve a housing development application if the project fulfills the following criteria:

  • The project is located on an urban infill site – meaning it is in an urban area, and 75% of the lot borders other developed parcels of land;
  • The site is zoned for residential or mixed uses in the jurisdiction’s general plan, and is consistent with objective design standards;
  • Developers pay prevailing wage on all projects with more than 10 units;
    • For projects with 50 units or more, the developer must provide healthcare benefits
    • For projects over 85 feet, the developer must prioritize hiring a skilled and trained workforce
    • When available, developers must hire workers participating in an apprentice program
  • The site is not located in farmland, wetlands, a very-high fire risk zone, a hazardous waste site, floodplains and floodways, a habitat for protected species, or land under a conservation plan or easement; and
  • The project follows all other applicable objective laws and ordinances, such as zoning rules and environmental safety rules.

The bill would authorize the Department of General Services to act in the place of a locality or local government, at the discretion of that department, for purposes of the ministerial, streamlined review for development in compliance with the above-described requirements on property owned by or leased to the state. The bill would extend the operation of the streamlined, ministerial approval process to January 1, 2036. The bill would provide that the streamlined, ministerial approval process does not apply to applications for developments proposed on qualified sites, defined as a site that is located within an equine or equestrian district and meets certain other requirements, that are submitted on or after January 1, 2024, but before July 1, 2025.

This bill would modify the above-described objective planning standards, including by deleting the standard that prohibits a multifamily housing development from being subject to the streamlined, ministerial approval process if the development is located in a coastal zone and by providing an alternative definition for “affordable rent” for a development that dedicates 100% of units, exclusive of a manager’s unit or units, to lower-income households.

The bill would, among other modifications, delete the objective planning standards requiring development proponents to pay at least the general prevailing rate of per diem wages and utilize a skilled and trained workforce and would instead require a development proponent to certify to the local government that certain wage and labor standards will be met, including a requirement that all construction workers be paid at least the general prevailing rate of wages, as specified. The bill would require the Labor Commissioner to enforce the obligation to pay prevailing wages. By expanding the crime of perjury, the bill would impose a state-mandated local program. The bill would specify that the requirements to pay prevailing wages, use a workforce participating in an apprenticeship, or provide health care expenditures do not apply to a project that consists of 10 or fewer units and is not otherwise a public work.
