RULES, ELECTIONS AND INTERGOVERNMENTAL RELATIONS COMMITTEE REPORT and RESOLUTION relative to establishing the City’s position regarding Senate Bill (SB) 423 (Wiener), to maintain the Coastal Zone exemption and provide an unconditional exemption for the Very High Fire Hazard Severity Zones.

Recommendation for Council action, pursuant to Resolution (Park – Yaroslavsky – Lee), SUBJECT TO THE CONCURRENCE OF THE MAYOR:

RESOLVE to include in the City’s 2023-24 State Legislative Program SUPPORT IF AMENDED for SB 423 (Wiener), to maintain the Coastal Zone exemption and provide an unconditional exemption for the Very High Fire Hazard Severity Zones.

Wildlife Corridor in the eastern area of the Santa Monica Mountains (Hillside Ordinance Zone).

CF 14-0518    UPDATE 

CONSIDERATION OF MOTION (KORETZ – HUIZAR, ET AL.) relative to creating a Wildlife Corridor in the eastern area of the Santa Monica Mountains (Hillside Ordinance Zone).

The City Attorney’s Office is now reviewing the Wildlife Ordinance. Once form and legality review is complete, it will go to the full City Council for consideration in the coming months. Additionally, at the direction of the PLUM Committee, City Planning has been instructed to provide a report of staffing resources required to implement the ordinance. City Planning and Council Districts 4 and 5 have prepared new fact sheets about the ordinance.

Instruct the DCP, BOE, BSS, in consultation with the City Attorney, to coordinate with other City departments, and take all necessary steps to ensure that the Eastern Santa Monica Mountains Natural Resource Protection Plan prepared by the SMMC will be considered by the City in the CEQA process to ensure the protection and conservation of sensitive habitat areas.

Instruct the DCP, BOE, BSS, in consultation with the City Attorney, to coordinate with other City departments, and develop a process to consider all future spatial habitat protection maps prepared by the SMMC.

Resolve that this Resolution will apply prospectively only and not to any discretionary CEQA approval published or sought from the City prior to the date this Resolution becomes effective.

Instruct the DCP, BOE, BSS, to report to the Council within 90 days on the status of the coordination efforts regarding the Eastern Santa Monica Mountains Natural Resource Protection Plan and a process for all future spatial habitat protection maps prepared by the SMMC.

Ridgeline Protection Ordinance Comment Period Extension

On June 17th, City Planning held a public hearing on the proposed Ridgeline Protection Ordinance (Case No. CPC-2021-3001-CA) and proposed Zone Change Ordinance (Case No. CPC-2021-3059-ZC) to apply the Ridgeline Protection regulations to the initial application area. As explained at the public hearing, public input and engagement are critical to this phase of the process. We appreciate and rely on your thoughts and comments to inform the upcoming revisions of the draft ordinances. To that end, the comment period for both of these ordinances has been extended.
The new deadline for submitting comments on these ordinances is end of day Monday, August 2, 2021. Please submit comments and questions to Planning.Ridgelines@lacity.org. We want to hear from you!

Ridgeline Protection Ordinance Public Hearing

In response to an adopted City Council Motion (Council File # 11-1441-S1), Los Angeles City Planning has prepared and released the Ridgeline Protection Ordinance (CPC-2021-3001-CA), which establishes a new Ridgeline Protection Supplemental Use District (SUD) in the Los Angeles Municipal Code. The Ridgeline Protection SUD will contain development regulations to preserve and protect the natural crests of the mountains that surround and bisect the City of Los Angeles.
Application of the proposed Ridgeline Protection Ordinance will occur through a separate Zone Change Ordinance (CPC-2021-3059-ZC), which will apply the SUD to a Pilot Area in Bel Air – Beverly Crest, as well as a portion of Hollywood. City Planning is holding a combined virtual Staff Public Hearing for both the Ridgeline Protection Ordinance, which was released on April 19, 2021, and the related Zone Change Ordinance. Prior to the start of the Public Hearing, staff will provide an overview presentation of the proposed ordinance and its application in a pilot area. Attendees will then have an opportunity to ask clarifying questions to staff prior to the start of the actual Public Hearing, at which point attendees are encouraged to provide comments and testimony for the public record. The hearing notice includes all the details on how to access the public hearing, which is scheduled for June 17, 2021, starting at 1 p.m.

Repair of Hillside Streets / Requiring Design and Engineering Intervention / Detailed Analysis / Work Plan

PUBLIC WORKS COMMITTEE REPORT relative to developing a recommended scope for a comprehensive study to assess hillside streets, and preparing a cost estimate.

Recommendations for Council action:

INSTRUCT the Bureau of Engineering (BOE) to work with the Bureau of Street Services (BSS), the Los Angeles Fire Department, and the Los Angeles Department of Transportation (LADOT) to develop a recommended scope for a comprehensive study to assess hillside streets, and prepare a cost estimate.

DIRECT the BOE to report within 120 days with details of the recommended study scope of work and associated funding request.

REQUEST the City Attorney and INSTRUCT the BOE and BSS to report on streets that had been previously removed from public use have been fully incorporated into the City’s street network and the steps necessary to incorporate the remaining streets

INSTRUCT the BOE, in consultation with LADOT, to report on the feasibility of making streets one-way streets to minimize the right of way acquisition of private properties.

LADOT Transportation Assessment Guidelines Addendum – Hillside Developments

To better address safety, access, and circulation concerns related to construction activities of new developments on narrow streets within hillside neighborhoods, the Los Angeles Department of Transportation (LADOT) releases this addendum to the LADOT Transportation Assessment Guidelines (TAG). This addendum provides guidance when considering traffic management measures for hillside development projects in narrow roadways of less than 24‐feet in width.

While most hillside developments screen out of a Vehicle Miles Traveled analysis according to the TAG, these projects may still require CEQA analysis to address potential geometric design hazards or emergency access concerns or may require a safety and access assessment outside of the CEQA process to consider how the construction activities impact local circulation, emergency access, deliveries, and street parking.

Prepare and present an amendment to the Hillside Construction Regulation Supplemental Use District to include the HCR overlay in all Council District 4 hillsides which feature high concentrations of active construction, substandard streets, restricted ingress and egress, below average emergency response times, lack of pedestrian infrastructure and location in VHFSZ; specifically including, but not limited to the communities of Bowmont Hazen, and Coldwater Canyon.

INSTRUCT the Department of City Planning (DCP) to prepare a report with updated cost information to prepare a Ridgeline Ordinance with development standards, inasmuch as the prior estimates were prepared in 2011 (Council file No. 11-1441), and that the DCP also report on the feasibility of a Ridgeline Ordinance as part of the current Fiscal Year 2015-16 DCP work program.

Recommendation for Council action, pursuant to Motion (Koretz – Ryu):

INSTRUCT the Department of City Planning, with the assistance of the Los Angeles Department of Building and Safety, Bureau of Engineering, and the Los Angeles Department of Transportation, and in consultation with the City Attorney, and any other relevant City department, to prepare and present an Ordinance that incorporates the following amendments, as described in the Motion, to the Bel Air-Beverly Crest Hillside Construction Regulation Supplemental Use District:

Notification to hillside residents for both haul route and demolition permit activity.
Ensure that Neighborhood Councils have the opportunity to provide comment on haul routes.
Ensure that graded and hauling activity is not taking place in advance of a project being approved.
Earmark a funding source that will be used to make repairs and improvements to the hillside street infrastructure commensurate to the cumulative wear and tear that results from large construction-related vehicles.

FIND, pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15074(b), after consideration of the whole of the administrative record, including ND No. ENV-2015-4197-ND-REC-1, as circulated on October 2, 2017 and the Addendum, and all comments received, that only minor technical changes or additions to the ND are necessary, and pursuant to CEQA Guidelines Section 15162, no subsequent Environmental Impact Report, negative declaration, nor addendum is required for approval of the project; that the ND reflects the independent judgment and analysis of the City; and, ADOPT the ND.

ADOPT the FINDINGS of the LACPC as the Findings of the Council.

The City of Los Angeles, Department of City Planning will hold a Public Hearing regarding the adoption of a new Supplemental Use District (SUD) and the application of this SUD to the Bel Air neighborhood. The proposed new Environmentally Sensitive Hillside Area (ESHA) District applied to the Bel Air neighborhood is being considered to address community concerns regarding construction impacts of large-scale single- family home developments in the hillsides. The proposed Environmentally Sensitive Hillside Area (ESHA) District will establish development standards regulating grading limits and hauling operation standards to areas that adopt the overlay. The ESHA District regulations will require single-family home development projects 20,000 square feet or larger within the district to go through a review process and will mandate standard hauling operations for all single family home developments as conditions of project approval. Information on both the proposed new Environmentally Sensitive Hillside Area District and the Zone Change Ordinance to apply the ESHA District to the Bel Air neighborhood, will be available for review at the Public Hearing and online at www.planning.lacity.org under “What’s New.”

Recommendations for Council action:

REQUEST the City Attorney to prepare and present an Ordinance to:

Require haul trucks to obtain a permit with the City of Los Angeles to stage immediately adjacent to a project site and develop an appropriate fee schedule for said permit.

Prohibit the staging or idling of haul trucks anywhere in the public right-of-way except immediately adjacent to the project site on obtaining the necessary permit.

Set maximum fines for violations of staging or idling in the public right-of-way without the requisite permit and that a portion of the fines be recouped for an enforcement program.

Fiscal Impact Statement: Neither the City Administrative Officer nor the CLA has completed a financial analysis of this report.

WELCOME!

The Department of City Planning is pleased to announce the kick-off of the Neighborhood Conservation Initiative, a focused work program tasked with identifying and protecting the character-defining features of Los Angeles’ unique residential neighborhoods. The Neighborhood Conservation Initiative will address the foremost issues confronting single-family neighborhoods by working with communities to develop the following:

An amendment to the single-family zones (Baseline Mansionization and Baseline Hillside Ordinances) across the City. A menu of new zoning options.  A proposal to apply new, tailored zones and Historic Preservation Overlay Zones (HPOZs) in select, neighborhoods identified in the Interim Control Ordinance (ICO).

The ultimate goal of the Neighborhood Conservation Initiative is to deliver permanent zoning solutions that minimize out-of-scale development across the City. The work program involves the following two phases, both to be completed within the term of the ICO, which expires in March of 2017:

Phase I:

Staff is in the process of drafting the proposed amendments to current single-family zones (Baseline Mansionization and Baseline Hillside Ordinances). These focused modifications are intended to address neighborhood character and out-of-scale single-family development based on community input and direction by City Council.
Phase II:
Beginning in early 2016, staff will be reaching-out to the residents and stakeholders of ICO neighborhoods to work collaboratively in identifying which of the new context sensitive single-family zones being developed through the re:code LA project are most appropriate for application within ICO neighborhoods. The re:code LA project seeks to create new single-family development regulations that respond to the prevailing and desirable scale, form and character of existing residences within the City.

Baseline Hillside Ordinance – CF14-1059 and CF14-1059 S1

City Council

INSTRUCT the Los Angeles Department of Building and Safety (LADBS) and the Bureau of Street Services, with the assistance of the Department of City Planning (DCP), and in consultation with the City Attorney, to prepare a report in 90 days that provides recommendations relative to the feasibility of:

– Modifying the exemption process for hillside grading.
– Including cement trucks into the haul route hearing process to provide Council offices with a mechanism to monitor and insure safety.
– Requiring a full completion bond on hillside projects and best practices.
– Increasing the notification for haul route hearings to include residents within a 500 square foot radius along with those residents living along the haul route, excluding those living along highways.
– Increasing the street bond for haul routes.

DIRECT the LADBS, with the assistance of the DCP, and in consultation with the City Attorney, to provide recommendations relative to best practices as it relates to withholding Certificate of Occupancy permits for outstanding violations, and the feasibility of revising the permitted hours of construction, and the potential impacts of limiting the hauling of dirt and cement pours to Monday through Friday, with no Saturday or Sunday hauling.

INSTRUCT the LADBS, in consultation with the City Attorney, to also report on the feasibility of requiring hillside project applicants to pay a hillside safety fee for increased inspections and infrastructure to protect neighborhood residents from the adverse impacts of large out of scale development projects.

DIRECT the LADBS to also include in its report information regarding:

– The inclusion of grading that results from caissons and other similar concrete shoring/footing elements.
– The requirement of a licensed contractor for homes of a certain size and not allowing owner/builder allowances for extremely large homes.

Motion – Amend Hillside Ordinance

City Council reviewed and adopted PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to a report on the Baseline Hillside Ordinance. Motion initiated: (Koretz – LaBonge):

INSTRUCT the Los Angeles Department of Building and Safety (LADBS) and the Bureau of Street Services, with the assistance of the Department of City Planning (DCP), and in consultation with the City Attorney, to prepare a report in 90 days that provides recommendations relative to the feasibility of:

Modifying the exemption process for hillside grading.

Including cement trucks into the haul route hearing process to provide Council offices with a mechanism to monitor and insure safety.

Requiring a full completion bond on hillside projects and best practices.

Increasing the notification for haul route hearings to include residents within a 500 square foot radius along with those residents living along the haul route, excluding those living along highways.

Increasing the street bond for haul routes.

DIRECT the LADBS, with the assistance of the DCP, and in consultation with the City Attorney, to provide recommendations relative to best practices as it relates to withholding Certificate of Occupancy permits for outstanding violations, and the feasibility of revising the permitted hours of construction, and the potential impacts of limiting the hauling of dirt and cement pours to Monday through Friday, with no Saturday or Sunday hauling.

INSTRUCT the LADBS, in consultation with the City Attorney, to also report on the feasibility of requiring hillside project applicants to pay a hillside safety fee for increased inspections and infrastructure to protect neighborhood residents from the adverse impacts of large out of scale development projects.

DIRECT the LADBS to also include in its report information regarding:

The inclusion of grading that results from caissons and other similar concrete shoring/footing elements.

The requirement of a licensed contractor for homes of a certain size and not allowing owner/builder allowances for extremely large homes.

The requirement for additional review, including those related to the California Environmental Quality Act, for homes of a certain size.

Baseline Hillside Ordinance Amendments – Motion 14-1049-S1

Since its inception on May 9, 2011, the City’s Baseline Hillside Ordinance (BHO) (No.181624,) has been the guiding land-use regulation for single family residential zoned properties (R1, RS, RE ( 9, 11, 15, 20, and 40), and RA properties located within the hillside designated areas.
Over the past four years, we have seen where the BHO has accomplished the intended goals of maintaining and promoting communities that preserve their integrity and livability. However, the past four years, and in more recent times, it has also shown us where the BHO has fallen far short of its mandate to create regulations that allow for sustainable neighborhoods that protect the interest of all homeowners.

Communities throughout Council District 5, including Bel Air-Beverly Crest, are deeply concerned about existing and future development of residential property in hillside communities, which has led to massive construction burdening entire neighborhoods.

to ensure the safety of city residents, the large scale development projects must be held to higher standard, by examining the cumulative impacts on our aging infrastructure and communities, and by amending the grading requirements set forth by the Baseline Hillside Ordinance.

As such, the Department of Building and Safety, with the assistance of other city departments, must take pro- active actions and recommend regulatory modifications to the existing permitting process, and discuss the feasibility of a hillside safety fee, in an effort to immediately begin protecting the safety of hillside neighborhoods to address the uncontrolled and uncoordinated large scale development that has been occurring in hillside communities.

I THEREFORE MOVE That the Council instruct the Department of Building and Safety, with the assistance of the Planning Department, and in consultation with the City Attorney, to prepare a report in 90 days that provides recommendations relative to best practices as it relates to with holding Certificate of Occupancy permits for outstanding violations, and the feasibility of revising the permitted hours of construction, and the potential impacts of limiting the hauling of dirt and cement pours to Monday through Friday, with no Saturday or Sunday hauling.

Hillside Area Protection

Motion – Hillside areas of the city are protected through the provisions of the zoning code, which prescribes the land use regulatory controls that govern land use policy in the city (Los Angeles Municipal Code, Chapter 1). In 1992, the Council adopted the Hillside Ordinance, establishing regulations for building setbacks, fire protection, lot coverage, parking, street access, sewer connections and grading for new construction in the fragile hillsides of the city. The Hillside ordinance provisions acknowledge the unique problems presented by Hillside development and provide for appropriate regulations to ensure that such development is safe and accessible. More specifically, the Hillside ordinance requires street access improvements for any new construction of a one-family dwelling on a lot fronting on a Substandard Hillside Limited Street, as delineated in LAMC Section 12.21 A 17 (e), Street Access, (Amended by Ordinance No. 174652, Eff. 7/27/02), as denoted below: “For any new construction of, or addition to, a one-family dwelling on a lot fronting on a Substandard Hillside Limited Street, no building permit or grading permit shall be issued unless at least one-half of the width of the street(s) has been dedicated for the full width of the frontage of the lot to Standard Hillside Limited Street dimensions or to a lesser width as determined by the City Engineer…” Community members need to be fully informed as to the current relief mechanisms that are available as it relates to the “fully improved street” provisions of the LAMC, and in the interest of good public policy the Planning Department should conduct public hearings in connection with any relief applications. THEREFORE MOVE that the Council instruct the Planning Department to prepare a report within 30 days before the consideration of the Planning and Land Use Management (PLUM) Committee, relative to the current relief options from the “fully improved street” provisions of the LAMC, as it relates to the construction of single family dwellings on a lot fronting on a substandard Hillside limited street; and FURTHER MOVE that the Planning Department conduct public hearings in connection with applications for relief from the “fully improved street” provisions of the LAMC. HILLSIDE ORDINANCE CLARIFICATION

Motion – In 1992, the City Council adopted the Hillside Ordinance, establishing regulations for building setbacks, fire protection, lot coverage, parking, street access, sewer connections and grading for new construction in the fragile hillsides of the City. These provisions acknowledge the unique problems presented by hillside development and provide for appropriate regulations to ensure that such development is safe and accessible. Building on hillside lots has increased dramatically over the past few years and it has come to the Council’s attention that certain provisions of the ordinance require clarification. In particular, Section 12.21 a 17 (i) provides for an exception to the provisions of the ordinance for any construction on a lot that fronts on a “fully-improved street” which meets or exceeds the dimensions of a hillside street (limited) as shown in the standard street dimensions of Standard Plan *S-470-0 *(Miscikowski – Feuer) as determined by the Bureau of Engineering. The meaning of “fully-improved street” requires clarification to ensure that development exempted from the provisions of the Hillside Ordinance is truly and fully accessible by fire safety and other emergency personnel. THEREFORE, MOVE that the Planning Department and the City Attorney be instructed to prepare an ordinance which clarifies that “fully-improved street” means the street on which a lot fronts meets or exceeds the dimensions of a Hillside Street (Limited) as shown in the Standard Street Dimensions of Standard Plan *S-470-0 *(Miscikowski – Feuer) for the entire length of the street from the lot to a collector street, a secondary or major highway, where the collector, major or secondary highway also meets or exceeds those Standard Street Dimensions for its entire length in the Hillside Area.
